بررسي مقايسه‌اي جايگاه رييس مجلس شوراي اسلامي ايران و سخنگوي مجلس نمايندگان آمريكا

Comparative Study of the Role of Chairman of the Islamic Consultative Assembly of Iran and Speaker of the House of the Representatives of U.S.

در راس مجلس نمايندگان آمريكا، به‌عنوان مجلس ملي اين كشور و يكي از دو ركن كنگره، سخنگوي مجلس نمايندگان قرار دارد و در راس مجلس شوراي اسلامي ايران، رييس مجلس. اگرچه متون اساسي و قوانين بنيادي، جايگاه ويژه‌اي براي اين دو تن تدارك نديده‌اند، با اين حال، داراي نقشي انكارناپذير هم در ساختار حكومت و هم در صحن مجالس خود هستند. بررسي مقايسه‌اي اين دو سمت حاكي از آن است كه سنت‌هاي ستبر پارلماني و رويه‌هاي جاافتاده تاريخي، گستره وسيعي از اختيارات و صلاحيت‌ها را براي سخنگو پديد آورده است كه شايد مشابه آن را به‌سختي بتوان در مجلس شورا ديد. آيين‌نامه داخلي رييس مجلس شوراي اسلامي را براي بسياري از اين قبيل اختيارات محدود ساخته و صراحتاً تكليف اين مسايل را با تقسيم كار روشن ساخته است. البته بايد اين نكته را خاطرنشان ساخت كه رييس مجلس شوراي اسلامي در قياس با همتاي خود در ايالات متحده، داراي اختيارات اداري گسترده‌تري است.

House of the Representatives in the U.S., as the National Assembly of this state and one of the two pillars of the Congress, is headed by Speaker and, Chairman of the Majlis is the head of the Islamic Consultative Assembly of Iran. Although the constitutional texts and fundamental laws do not provide a special place for these two authorities, however, they have an undeniable role in the structure of government and in the courtyard of their houses. A comparative study of the two shows that parliamentary traditions and historical practices have made a range of qualifications and powers for the Speaker of the House of the Representatives that are hard to see in the Iranian Majlis. The chairman of Majlis has been limited by the internal regulations statute, and it has explicitly resolved these issues. It is should is to be noted that the President of the Majlis, compared to their counterparts in the United States, has a greater administrative powers.
