استنباط احكام فقهي از قصص قرآن از منظر اهل تسنن

Inference of Jurisprudential Rules out of Quranic Stories from Sunniviewpoint

قرآن كريم بعنوان نخستين و مهم ترين منبع احكام شرعي، پاسخ گوي تمام نيازهاي بشر در تمام زمينه هاست؛ از اين رو، اكثر احكام فقهي اين معجزه الهي بدون تفصيل بوده و همواره در قالب امر و نهي نيست؛ بلكه گاهي در لابلاي ديگر معارف قرآن، مانند مباحث اعتقادي، اخلاقي و امثال و قصص قرار گرفته است. قصص، يكي از موارد و مضامين سراسري، تكرار شونده و تاثيرگذار قرآن كريم مي باشند و افزون بر اين كه دربردارنده نكته ها و عبرت هاي فراواني هستند؛ در بسياري از موارد در نقل و لابلاي آنها احكامي بيان شده و مي توانند ميدان استنباط و تفقّه باشند. بكارگيري قصص قرآن در راستاي استنباط احكام، دستاوردهاي فراواني در مسايل مختلف از جمله در زمينه معاملات و امور اجرايي و قضايي دارد؛ چنان كه اين امر در آثار علماي مذاهب، مشهود بوده و آنان احكام زيادي از آيات قصص استخراج كرده اند؛ از جمله: مشروعيت قرعه و جعاله و ضمانت و وكالت و اجاره، اطلاق اسم فرزند بر دخترزاده، و حرمت غنا و موسيقي.

Quran as the first and main source of religious orders, answers all human needs in all fields; hence, the most jurisprudence rules of this miracle of God is without detail and not always in command and prohibition; but sometimes located in amidst other Quran topics such as religious and moral issues, proverbs and stories. Stories, one of the most influential and repetitive of the Quran topics, in addition to being have lots of advice and lessons; in many cases, from their intents and purposes are obtained contents that can be field of inference and fiqh. Using Quranic stories to deduce the laws, gains a lot of great achievements in different issues such as trade and administrative and judicial fields; as religious Jurists have been extracted many rules in the various issues from stories verses; such as: legitimate of lot and reward and guarantee and delegation and rent, predicate name of child to grandchildren from daughter, and unlawfully of music and singing
