پيامدهاي منفي تاسيس جزاير مصنوعي امارات در خليج‌فارس از منظر حقوق بين‌الملل درياها

Negative Consequences of Establishment of Artificial Islands in Persian Gulf by UAE, Regarding International Marine Law

امارات متحده عربي با ساخت جزاير مصنوعي متعدد در خليج‌فارس موجب برانگيختن حساسيت‌هاي فراواني ازسوي كشورهاي منطقه به خصوص ايران شده است. كشورهاي كوچك حاشيه خليج‌فارس سعي بر آن دارند تا با ساخت جزاير مسكوني، تجاري و اقتصادي مصنوعي اراضي تحت مالكيت خود را افزايش دهند و در اين راه از هيچ كوششي دريغ نمي‌كنند. يافته‌هاي اين پژوهش بيانگر آن است كه قلمرو‌سازي وسيع امارات با چنين سرعتي از يك‌سو مي‌تواند باعث طولاني شدن روند تعيين مرزهاي دريايي ايران و تيرگي روابط دو كشور و دخالت كشورهاي فرامنطقه‌اي در حاشيه خليج‌فارس شود و ازسوي ديگر ساخت اين جزاير موجب نابودي گونه‌هاي بي‌نظير و كم‌نظير موجودات دريايي و تيرگي و گل‌آلود شدن آب و جابه‌جايي رسوبات كنار ساحل شده است. علاوه‌بر موارد ذكرشده پيامدهاي منفي اقتصادي را بايد عنوان كرد كه آثار منفي بر اقتصاد ايران خواهد داشت. در اين پژوهش به بررسي حقوقي آثار مخرب ساخت اين جزاير به‌ويژه بر محيط زيست شكننده خليج‌فارس و مشكلات احتمالي تاسيس جزاير مصنوعي در زمينه افراز مرزها با توجه به عدم تعيين خطوط مرزي امارات در خليج‌فارس پرداخته خواهد شد.

United Arab Emirates by construction of its numerous artificial islands in the Persian Gulf has caused the offence of countries of the region, especially Iran. Small countries bordering the Persian Gulf try to increase their territory by building artificial islands and they spare no effort for it. These efforts include building residential, commercial and economic islands. This extensive expansion of territories by UAE can lengthen the determination process of Iranian sea borders. Moreover, it will darken the relationship of two countries and cause intervention of trans-regional countries in the Persian Gulfʹs bordering countries. On the other hand, construction of such islands can destroy unique types of sea species and obscure and mud water and relocate sediments along the shore. Above all, negative economic consequences should also be noted that will have negative effects on the economy of Iran. This research has focused on devastating effects of constructing such islands, especially on Persian Gulf’s fragile environment, and possible problems of their construction regarding the borders partition, since UAE’s borderlines in Persian Gulf are indeterminate.
