وضعيت حقوقي بيگانگان در ايران در پرتو انساني‌شدن حقوق بين‌الملل

The Status of Foreigners in the Iranian in the Light of Humanization of International law

چكيده حضور بيگانگان در قلمرو دولت‌هاي ديگر، رخدادي نو نيست، طبيعي است كه اين حضور، از نظرِ حقوقي براي فرد تبعاتي دارد و بيگانگان از حداقل حقوق پذيرفته‌شده دولت‌ها برخوردار مي‌شوند. با وجود اين، در روند تحولِ حقوق بين‌الملل از چارچوب دولت‌محوريِ حاكم بر آن به انساني‌شدن حقوق بين‌الملل، وضعيت حقوقي بيگانگان نيز در حال تغيير است، تغييري كه ضمن تثبيت و تبيين معيارهاي رفتاري با بيگانگان در جوامع ميزبان، به رهيافت‌هاي حقوق بشري نيز توجه مي‌شود. از اين رو، ضروري است ضمن بررسي رژيم حقوقي اتباع بيگانه در ايران و توجه به قوانين و مقررات موجود پيرامون وضعيت و بهره‌مندي اتباع بيگانه از حقوق پيش‌بيني‌شده در قوانين جمهوري اسلامي ايران، ديدگاه‌ها و نگرش‌هاي مطرح‌شده در اين زمينه در پرتو روند انساني‌شدن حقوق بين‌الملل و تحولات روزافزون حقوق بشر بررسي، و با توجه به حساسيت جامعه بين‌المللي به رعايت حقوق اتباع بيگانه و لزوم رعايت مقررات و الزامات حقوق بين‌الملل، راهكارهاي مورد نظر براي بهبود وضعيت موجود تحليل و بررسي شود.

Abstract The presence of foreigners on the territory of other countries has a long history and it is not an unusual issue. Explicitly this presence entails some legal effects. In any country, foreigners have minimum rights recognized by that country. Nowadays, as a result of developments in international law by moving from an inter-state towards an individual rights perspective, the legal status of foreigners has witnessed some changes. In this process, in addition to determination of legal standards for treatment with foreigners in the host countries, the human rights approaches should also be considered. For these developments, it is necessary to examine the legal status of foreigners in the Iranian legal system in light of human rights developments and humanization of international law. As the rights of foreigners in the host country is an international sensitive issue, the improvement of laws and regulations of the Islamic Republic of Iran in lieu of humanization of international law is necessary.
