جايگاه پيشگيري اجتماعي رشدمدار در قانون رسيدگي به تخلفات رانندگي

Position of Growing Social Prevention in Law of Studying Driving Violations Passed in 1389

يكي از شيوه هاي موثر در پيشگيري از جرايم و تخلفات رانندگي از بين بردن زمينه‌هاي بروز ارتكاب اين تخلفات است، به طوري‌كه تدابير مقنن بر اتخاذ يك سياست جنايي مناسب و كارا واقع شود. در اين نوشتار به بررسي نقش پيشگيري اجتماعي رشدمدار در كنترل جرايم و تخلفات مربوط به رانندگي و جايگاه آن در قانون رسيدگي به تخلفات رانندگي، پرداخته شده است. اين مطالعه از لحاظ روش توصيفي از نوع اسنادي است و جامعه آماري آن‌را كليه منابع اطلاعاتي در حوزه پيشگيري اجتماعي رشدمدار بوده است كه محقق به تحليل جايگاه و نقش اين‌نوع پيشگيري در قانون رسيدگي به تخلفات رانندگي پرداخته است. نتايج اين مطالعه نشان داد كه به پيشگيري اجتماعي به‌عنوان مهم ترين و اصلي ترين راه پيشگيري از جرايم و تخلفات توجه كافي نشده است.

The danger derived from transportation devices is increasing parallel to the level of their usage and every day we are witness of financial and life damages. This problem is more threatening for human life in the future. In these conditions policies should be codified in order to prevent incidence of driving accidents so that legislative plans about applying criminal policies are suitable and efficient. In this article the role of growing social problems in control of crimes and violations and its position in law of considering driving violations are studied. Growing social prevention is a kind of prevention policy which is in seeks of creation changes and individual reforms and efficient conditions on person. The addressee of this research is a person whom his personality is evolving. The aim of this study is determining the fact that to what extent the legislator focuses on growing social prevention. In this research the data are analyzed in an analytical and descriptive method. The result indicate that the most important and main method of prevention from crimes and violations has not been emphasized. This study suggests that in future legislations this matter should be considered.
