بررسي مباني فقهي ـ حقوقي بيع اعضاي بدن انسان با رويكردي به نظر امام خميني(س)

Studying Jurisdictional-Legal Grounds of Human Body Organs with an Approach based on Imam Khomeini’s Views

با پيشرفت علوم در زمينه‌هاي مختلف و پيدايش سوالات نوظهور در مسايل حقوقي و فقهي بر اساس رفع شبهات احتمالي بر پايه نقش اجتهاد در زمان و مكان، استدلال و استنتاج در پاسخ به سوالات فقهي و حقوقي به نحو قابل قبول از وظايف محققين امر است. بيع اعضاي بدن از آن دسته موضوعاتي است كه بر پايه توسعه علوم پزشكي صورت گرفته است. توجيه يا رد پذيرش بيع اعضاي بدن در حوزه سلامت انسان‌ها خصوصاً در زمينه پيوند اعضا بسيار مهم و حايز اهميت است. در مقاله حاضر بر اساس فقه پويا و مطابق نظر امام خميني، كه معتقد به تاثير زمان و مكان در فقه بودند، به اثبات مي‌رسد كه بيع اعضاي بدن مادامي كه سبب «اضرار به نفس» نگردد، بلامانع است.

Upon rapid development in various sciences and upon the appearance of new questions on legal and jurisdictional issues the researchers are obliged to find answers to these questions to remove the probable ambiguities based on the role of Ijtihad or religious imitation in time and place, reasoning and deduction. The sale of body organs is among the issues that has emerged after the development of medical sciences. It is highly important to legally and religiously reject or justify the sale of body organs particularly when transplant is needed. This paper has been developed based on dynamic jurisprudence and according to the views of Imam Khomeini, who believed in the effect of time and place in jurisprudence, and finally concludes that as far as the sale of body organ is not to the detriment of the giver’s “self”, it will be permissible.
