Methodology of Interactive and Contradictory Communications in Ethical and Legal Propositions based on Imam Khomeini’s Practical and Theoretical Conduct

تاثير متقابل اخلاق و حقوق بر يكديگر از مباحث مهمي است كه از ديرباز محل اختلاف علماي حقوق و اخلاق بوده است. در اين ميان بررسي سيره نظري و عملي امام خميني از اهميت ويژه‌اي برخوردار است؛ زيرا ايشان به عنوان يك فقيه و عارف بزرگ، صاحب آراي ارزشمندي در زمينه حقوق و اخلاق هستند. با مطالعه سير تحول مكاتب حقوقي و اخلاقي چند سوال مهم مطرح مي‌شود. مهم‌ترين مسيله روش شناسيِ تحليلِ موضوع است. اين روش بسان نقشه‌اي است كه ما را جهت يافتن پاسخ صحيح ياري مي دهد. مطابق فرضيه مقاله حاضر، نخست بايد با توجه به ديدگاه و روش امام درخصوص تقسيم علوم، به فهم دقيق و مشتركي از اخلاق و حقوق و جايگاه آنها دست يافته و تحليل مناسبي از سيره بنيانگذار نظام حقوقي مربوطه ارايه دهيم. در وهله دوم ضروري است با توسل به علم منطق و ارتباطات چهارگانه، صور مختلف ارتباطي را ترسيم نموده و بر اساس آن حكم حالات تعارض را بيابيم. در پايان نيز براي ملموس شدن موضوع، به مثال‌هايي از حقوق ايران بسنده مي شود.

The influence of ethics and law on each other has been among important issues and source of dispute among the ulema of ethics and law. In the meantime, studying the theoretical and practical conduct of Imam Khomeini is of special significance since he has valuable opinions on both ethics and law as a great jurist and theosophist. The study of the evolution of legal and ethical schools of thought puts forward a few questions to answer. The most important issue, in the meantime, is the methodology of subject analysis. This method is like a roadmap that leads us toward finding the right answer. According to the hypothesis of this paper, the first thing to do is to get an accurate and joint understanding of ethics and law with respect to Imam Khomeini’s views on division of sciences in order to present the conduct of the founder of the pertinent legal system. In the second stage, it is necessary to stick to the logics and four forms of communication to picture these diversified forms of communication to find the contradictory forms accordingly. In the end, examples have been included from Iranian law to make the subject matter more palpable
