Family Rights and Satellite Broad Casted Programs

نهاد خانواده به‌عنوان مهم‌ترين واحد اجتماعي هميشه مورد توجه و حمايت علم حقوق بوده است، با صنعتي شدن جوامع و تغييرات دروني و بيروني در نهاد خانواده توسط عوامل متعدد از جمله ماهواره‌ها نياز به راهكارهاي جديد حمايتي در اين موضوع به چشم مي‌خورد. از طرفي ماهواره‌ها با تاثير بر سبك زندگي و الگوي بومي خانواده‌ها سبب سو معاشرت، خشونت، سستي مباني خانواده، سخت شدن تربيت فرزندان و انحرافات در اخلاق و فرهنگ جنسي نهاد خانواده شده‌اند. حال مي‌دانيم كه طبق قوانين اساسي و مدني، تحكيم خانواده، تشييد مباني خانواده، معاضدت در تربيت فرزندان، هرچند به عنوان تكاليف والدين ذكر شده است. اما از حقوق اصلي اين نهاد به حساب مي‌آيند. هرجا كه تكليف وجود دارد صاحب حق نيز موجود است. نهاد خانواده به عنوان يك پديده اجتماعي از همه اين حقوق برخوردار است. به نظر مي‌رسد كه بررسي حقوق نهاد خانواده در برابر برنامه‌هاي ماهواره‌اي در قوانين فعلي و ارايه راهكار براي حمايت از خانواده يكي از خلاهاي موجود در فضاي حقوقي و ارتباطاتي را پوشش مي‌دهد كه در اين مقاله به آن خواهيم پرداخت.

Family has been always regarded as the most important social unit in protection and attention of law. Due to industrialization of societies and the internal and external changes of family and other influencing factors such as broadcasting satellite channels, it seems that new approaches are required to support the unit of family. On the other hand, broadcasting of satellite channels would affect the lifestyle and local pattern of families which may involve families in problems with socialization, abusive behavior, violence, weakness of family foundations, difficulties in educating children, and development of sexual deviations of families based on their culture and values. Although in constitutional and civil law, strengthening families, building strong foundations in the family and parental childrearing practices are mentioned as the rights and tasks of families, are not sufficient in terms of recent changes. Everywhere that there is a duty, there is a titular. The family as a social phenomenon has all these rights. It seems that investigation of the familyʹs rights against satellite programs in current law, and providing a mechanism to support the family could cover the gaps which exist in the legal and communicational space which will be discussed in this paper.
