The Historical Process of the 1975 Algeriaʹs Convention – Arvandrood (1975 – 1081)

بنيان پژوهش حاضر مبتني بر پايبندي به عهدنامه ي 1975 كه از جامعيت و يكپارچگي لازم برخوردار است و براي حل اختلاف بين ايران و عراق داراي اهميت حياتي مي باشد. روش اين پژوهش تاريخي - كتابخانه اي است و در اين مسير مشخص گرديد كه اختلافات بين دو كشور داراي تاريخي طولاني است. پس از استقلال عراق، منازعات مرزي با ايران افزايش يافت و دو كشور به طور دائم در تلاش براي حل اين منازعات با سازوكارهاي حقوقي بوده اند كه از مهمترين اين اقدامات، انعقاد قرارداد 1975 الجزاير مي باشد. عهدنامه ي الجزاير با در نظر گرفتن نحوه ي تدوين محتوايي و جزئيات حقوقي آن از جامعيت لازم برخوردار است. اين قرارداد كامل ترين عهدنامه براي مديريت دراز مدت اختلافات ژئوپلتيكي بين ايران و عراق است و اروند رود به طور طبيعي يك خط مرزي را تشكيل مي دهد. اگر چه بعضي از دولتمردان فعلي عراق ديدگاه هاي جديد و گاهي مغرضانه در مورد اين قرار داد دارند، به هر حال اجرايي كردن كامل عهدنامه و پايبندي دو كشور به آن پروتكل الحاقي تأمين كننده ي منافع جمهوري اسلامي ايران است و ديدگاه هاي جديد از طرف مقابل به عنوان تهديد تماميت ارضي ايران مي باشد.

The basis of this research is on the adherence to the 1975 convention that is comprehensive and integrated and is considered crucial and necessary to resolve a dispute between Iran and Iraq. The study was conducted in historical - library research method and in this way it was found that the disputes between the two countries have a long history. After the independence of Iraq, border disputes with Iran and the two countries increased constantly they were after legal mechanisms to solve the conflict among them was 1975 Algeriaʹs Convention the most important. The Treaty of Algeria, considering how to develop legal content and details, has the necessary comprehensiveness. The convention would be a perfect contract for the management of long-term geopolitical conflict between Iran and Iraq and Arvand Rud normally forms a boundary line. Although some of the current Iraqi government bodies have sometimes biased views about the contract, however, the full implementation of the Convention and the two countriesʹ adherence to the Additional Protocol would guarantee the provision of interests of the Islamic Republic of Iran and the new perspectives on the opposite side are considered as a threat to Iranʹs territorial integrity.
