بررسي وضعيت حقوقي استرداد مجرمين در قلمرو حقوق كيفري بين المللي

The Investigation of the Extradition of Criminalsʹ Legal Situation in the Realm of International Criminal Law

امروزه كنترل جرايم علاوه بر تلاش كشورها در سطح داخلي به ويژه با توجه به گسترش جرايم سازمان يافته و فراملي، مستلزم همكاري منطقه اي بين كشورهاي مختلف و در مواردي همكاري همه كشورهاي جهان مي باشد. همكاري كشورها در خصوص مبارزه و كنترل جرايم به خصوص جرايم بين المللي فرامرزي در قلمرو حقوق كيفري بين المللي مطرح مي باشد. در حقوق كيفر بين المللي اين همكاري مي تواند در دو عرصه مهم شامل معاضدت قضايي و استرداد مجرمين واقع شود. هدف از انجام اين تحقيق، تعيين وضعيت كنوني قرارداد استرداد مجرمين در قلمرو حقوق كيفري بين المللي با نگاهي به قرارداد استرداد مجرمين بين دولت جمهوري اسلامي ايران و ساير كشورها مي باشد. به اين منظور با مراجعه به منابع علمي مدون شامل كتاب و مقالات علمي، پايان نامه ها و رساله هاي دانشجويي و همچنين پژوهش هاي علمي صورت گرفته، اطلاعات مرتبط با موضوع تحقيق به روش اسنادي استخراج و جمع آوري شده و سپس به روش تحليلي و توصيفي مورد تجزيه و تحليل قرار گرفته اند. نتايج حاصل از اين بررسي نشان مي دهد كه با وجود ضرورت انعقاد معاهده بين المللي و تفاهم جهاني بين كشورهاي جهان در خصوص استرداد مجرمين، با اين وجود به دلايل مختلف عمدتاً سياسي تاكنون چنين موافقتنامه اي در سطح جهاني منعقد نگرديده و موافقتنامه هاي استرداد مجرمين محدود به موافقتنامه هاي منطقه اي مي باشد.

Today, crime control requires efforts of countries in the local level, especially with regard to the spread of organized crime and trans-regional, as well as regional cooperation between different countries and in some cases the cooperation of all countries of the world. The cooperation of our country in the fight and control against international crime, particularly cross-border crimes, is in the realm of international criminal law. In international criminal law, this cooperation can be in two important areas of judicial assistance and extradition of criminals. The aim of this study was to determine the current status of the extradition treaty in the field of international criminal law with a view to extradition of criminals agreement between the Islamic Republic of Iran and other countries. For this purpose, referring to written literature, including books and scientific papers, theses and dissertations for students as well as the scientific research, the required data were extracted and using documentary study and then have been analyzed via analytical and descriptive method. The results of this study show that despite the need for an international treaty on extradition of criminals and international cooperation between countries, for different reasons, mainly political such an agreement has not been signed at the global level and extradition of criminals agreements are limited to regional agreements.
