Supportive contexts of the injured pilgrims in the light of the international responsibility of the Saudi government

فاجعه منا و عمق آثار فردي، اجتماعي، داخلي و بين‌المللي آن، فراتر از يك مسئله معمولي است و گذشت زمان هم نمي‌تواند آن را به فراموشي بسپارد. اين فاجعه آن‌گاه عميق‌تر خود را نشان مي‌دهد كه با دولتي بايد طرف شد كه علي رغم ادعاهاي زياد، به ابتدايي‌ترين قواعد حقوقي اعتقادي ندارد. از جنگ در يمن و استفاده بي‌رويه از هواپيماهاي نظامي گرفته تا نوع نگاه به ساير مسلمانان، همگي حاكي از اين مهم است. اين دولت حتي به آموزه‌هاي اسلامي در مورد تمامي مسلمانان نيز باور ندارد.ا همة اين اوصاف دلايل متعدد حقوقي و فقهي وجود دارد كه اثباتگر مسئوليت دولت عربستان در اين فاجعه است. با اثبات مسئوليت بين‌المللي مي‌توان با استفاده از راهكارهاي حقوقي و سياسي، اين دولت را وادار به پاسخگويي كرد. يافته تحقيق با رويكرد به حقوق بين‌الملل، نشان مي‌دهد مسير پيش رو، هموار نيست، ولي بن‌بست هم نيست. ابزارها و راهكارهاي مختلف سياسي و حقوقي و البته در حد ضرورت و بدون ورود به شرايط جزئي، در اين نوشتار مورد توجه قرار گرفته است.

Mina disaster and depth of the personal and social impacts, internal and international, is more than a typical problem and it cannot also be forgettable over time. The disaster shows itself deeper when despite many claims the government does not believe in the most basic rules of legal rules. The war in Yemen and the indiscriminate use of military aircraft to the approach to other Muslims all indicate this matter. Even the government does not believe in the teachings of Islam on all Muslims. Nevertheless, there are several juridical and legal proofs and reasons demonstrate the responsibility of Saudi government in this tragedy. By proving international responsibility through legal and political strategy, the government could be forced to respond. The results of this research with international law approach, shows that the path ahead is not smooth, but not a deadlock. Political and legal tools and solutions of course as necessary and without going into detail conditions were taken into account in this article.
