اصلاح ساختارهاي قانوني، نظارتي و فرهنگي در مبارزه با فساد اداري

زمينه و هدف: فساد اداري كه بستر آن، نظام اداري و اداره امور دولتي است، زمينه‌اي فراهم مي‌كند كه كارمندان فاسد از موقعيت انحصاري خود در ارايه خدمات به ارباب‌رجوع بهره مي‌گيرند و با شغل خود به تجارت غيرقانوني مي‌پردازند. روش تحقيق: اين مقاله به روش توصيفي تحليلي و با استفاده از منابع كتابخانه‌اي انجام‌شده است. يافته‌ها: در شرايط فساد اداري، كارمندان فاسد با سو استفاده از موقعيت شغلي ايجادشده، دست به اقداماتي مي‌زنند كه حقوق اجتماعي، اقتصادي و سياسي شهروندان را ناديده مي‌گيرند. اشكالات موجود ناشي از خلاهاي قانوني، نبود سيستم‌هاي نظارتي قوي و سستي ساختارهاي فرهنگي و اخلاقي جامعه، از عوامل زمينه‌ساز اين وضعيت است. قانون‌گذار با تصويب قانون ارتقا سلامت اداري و مقابله با فساد و دولت با تدوين و تصويب آيين‌نامه‌هاي مرتبط و فعال كردن دستگاه‌هاي نظارتي با همكاري قوه قضاييه، توانسته‌اند به اصلاح ساختار قوانين و كنترل بپردازند. جامعه نيز با تقويت ساختارهاي فرهنگي و اخلاقي خود توانسته است در مرحله‌ي اول با از بين بردن زمينه‌ي فساد اداري و در مرحله‌ي بعد با نظارت و گزارش آن به مراجع ذي‌ربط در مبارزه با فساد اداري كمك زيادي كند. نتيجه‌گيري: فساد مالي، پديده‏اي پيچيده است كه با اصلاح ساختار قوانين، اصلاح كنترل و مسيوليت‌پذيري و اصلاح ساختار فرهنگي و اخلاقي جامعه از بين مي‌رود.

Setting and Purpose: Administrative corruption with the context of administrative system and managing government affairs, lays down the setting in which corrupt staffs take advantage of their own position to do services to clients and to do illegal business. Research method: This article has been conducted in descriptive and analytical method using library resources. Findings: In administrative corruption, corrupt staffs make their efforts to ignore social, economical and political rights of citizens considering their job position. The problems cased by legal gaps, lack of powerful supervisory systems and weakness of cultural and moral structures of society, are the factors paving the way for this situation. Legislator could modify the structure of rules and its control, by the approval the of the haw enhancing administrative flawlessness and combating corruption and governmentʹs codification and approval of the related procedures and activation of supervisory systems with cooperation of judicature. Society boosted its cultural and moral structures and consequently could first helped fighting administrative corruption a lot by preventing the setting for this corruption and next by supervising and reporting it to the qualified authorities. Conclusion: Administrative corruption is the complicated phenomenon that is eliminated by modifying law structure, control and accountability and cultural and moral structure.
