An overview of behavioral standards (rules) of justice registrars at Iran law

استانداردسازي رفتار ضابطان در رويه‌ها، برخورد با متهمان و مجرمان به منظور تحقق رفتار واحد از سوي كليه ضابطان در هر كدام از نهادهاي حاكميتي موجب گسترش عدالت، نظم در فرآيندها و روندهاي قضايي مي‌گردد. امري كه در حال حاضر لزوم آن بسيار احساس مي‌گردد. اين پژوهش با استناد به قوانين موضوعه (عادي) مصوب مجلس شوراي اسلامي و قانون اساسي، به تشريح جايگاه قانوني ضابطان و نقش آنان در ايجاد عدالت مي‌پردازد. با توجه به لزوم و ضرورت رفتار واحد و قانوني ضابطان، در اين پژوهش حوزه‌هاي مختلفي كه ضابطان با آن در ارتباط مي‌باشند، مشخص و رفتار ضابطه‌مند (استاندارد) بر اساس قانون بيان مي‌شود. در راستاي هدف مذكور و پاسخ به سوال اصلي پژوهش كه تعيين ضوابط حاكم بر رفتار ضابطان دادگستري مي‌باشد، علاوه بر كليات، رفتار استاندارد ضابطان در حوزه‌هاي بازداشت، تفتيش و بازرسي خودرو، نحوه عملكرد ضابطان دادگستري در برابر جرايم مشهود و غيرمشهود، استماع شهادت شهود، كيفيت احضار شهود، ورود و تفتيش منازل و اماكن و اشيا ، جلب و دستگيري، اعلام مراتب وقوع جرم به مقام ذي‌صلاح قضايي بيان شده است. در راستاي تحقق نگرش علمي و كاربردي به پژوهش صورت گرفته، ضمن استفاده از روش تحليلي و توصيفي، از مصاحبه و اخذ پرسشنامه از برخي ضابطان وزارت دفاع اقدام به‌عمل آمد. فرم‌هاي مورد اشاره به گونه‌اي طراحي گرديد تا دانش و رويكرد ضابطان وزارتخانه مذكور به قانون و كرامت انساني مورد آزمايش قرار گيرد. هدف اين پژوهش، ضمن تشريح استانداردهاي رفتار ضابطان، تحقق عدالت (تناسب)، ارتقا حقوق و كرامت انساني متهمان و مجرمان، بالارفتن درجه اعتماد به ضابطان و نظام قضايي را مدنظر و در نهايت تامين هر چه بيشتر عدالت در جامعه ايراني مي‌باشد.

Standardization the behavior of in procedures, in dealing with suspects and criminals in order to achieve the same behavior on behalf of all registrars in each of government agencies causes extension of justice, order in process and judicial proceedings. It is something that we feel is necessary. The study by cited statute (regular) Act of Parliament and the constitution describes legal status of registrars and their role in establishment of justice..Due to the importance and necessity of the unique behavior and law of the registrars, the different areas that the registrars are associated with in this study will identify and the regulation behavior (standard) will express based on the law. According to mentioned purpose and replying to them a in question of study that it is determination of the governing criteria on the justice registrars, in addition to generalities it is expressed, standard behavior of the registrars in the detention areas, inspection, and examination of the car, how performance of justice registrars against the visible and invisible crimes, hearing the testimony of witnesses, the quality of the call-up of witness, entering and inspection of the homes and places and objects, caught and arresting, announcing the crime degrees to the appropriate judicial authority. In order to fulfill the scientific and practical approach to the conducted study, while using of the analytical and descriptive method, it was done an interview and obtained the questionnaires from the some department of defense’s registrars. The mentioned form was designed in a way till it be tested the Knowledge and the mentioned ministries ’approach of registrars than the law and human dignity. The purpose of this study while describing the standard of the registrars’ behavior is achievement of the justice (balance), the promotion of rights and human dignity of the defendants and off enders, in creasing degree of confidence to the registrars and judicial system and finally it is providing more justice in the community.
