Juvenile Police, Requirements and Mechanism (A Comparative Study: American Legal System)

پليس ويژه كودكان و نوجوانان به عنوان يكي از نهادهاي اختصاصيِ نظام دادرسي اطفال، در ايران براي نخستين بار در لايحه رسيدگي به جرايم اطفال و نوجوانان (1383) پيش‌بيني و پس از آن به صورت ضمني در قانون برنامه پنج‌ساله پنجم توسعه، مورد تأكيد قرار گرفت. وانگهي به دليل عدم تصويب لايحه و همچنين اجرايي نشدن قانون برنامه توسعه، قانونگذار در قانون آيين دادرسي كيفري 1392 و در ماده 31 قانون آيين دادرسي كيفري ايجاد پليس مخصوص اطفال و نوجوانان را پيش‌بيني و سازمان پليس را مكلف به تشكيل آن نمود. اگرچه تشكيل پليس ويژه مي‌تواند در بهبود عملكرد سازمان پليس و نظام عدالت كيفري در رابطه با اطفال و نوجوانان مؤثر باشد. نتايج حاصل از پژوهش حاضر نشان مي‌دهد كه تأسيس پليس ويژه اطفال و نوجوانان بدون لحاظ الزامات خاص اين گروه سني و همچنين عدم بهره‌گيري از سازوكارهاي ويژه و اختصاصي مؤثر نبوده در نهايت موجب فربهي و كاهش چالاكي بيشتر سازمان پليس خواهد شد. بررسي تطبيقي موضوع در كشورهاي مختلف و به ويژه امريكا نشان مي‌دهد كه لازمه كارآمدي و بهره‌وري پليس اطفال و نوجوانان تغيير ساختار سازماني، ايجاد نظام آموزشي نظام‌مند، پيش‌بيني سازوكارهاي رفتاري و ارتباطي مؤثر، به كار‌گيري فرآيند انجام مصاحبه ويژه، پيش‌بيني ضمانت اجراهاي قابل اجرا توسط پليس و اتخاذ سازوكارهاي پيشگيري پليسي است. بر اين اساس، باتوجه به نوظهور بودن آن در نظام عدالت كيفري ايران پژوهش حاضر بر آن است ضمن مطالعه اجمالي سير تحولات تقنيني در رابطه با پليس اطفال و نوجوانان در عرصه بين‌المللي و همچنين نظام حقوقي ايران و امريكا، به صورت مشخص الزامات و سازوكارهاي تشكيل پليس كودكان و نوجوانان در ايران را شناسايي و با استفاده از تجربه ساير كشورها در اين زمينه راهكارهاي اجرايي و عملي با هدف تشكيل مناسب، اثربخش و كارآمد پليس اطفال و نوجوانان ارائه نمايد.

Now under numerous international conventions Such as Convention on the Rights of the Child (1989) and United Nations Standard Minimum Rules for the Administration of Juvenile Justice (1985), many countries have forecasted special rules in relation to juvenile delinquency and victimization. Juvenile police is a One of the specific institutions In relation to juvenile justice system. Although with the use of juvenile Officer the police can improve the performance of the it’s Organization and the criminal justice system in relation to children and young people. But the results of this study show that Formation of the Police without regard to the specific requirements of this age group and without the use of special mechanisms is not effective and eventually causing the obesity and reduce the Performance of police organization. A comparative study in various countries, especially in America shows juvenile police Requires the Changing in the organizational structure, Create the Systematic educational system, Forecast the Communicational and behavioral effective mechanisms, use of special interview process, Forecast police sanctions And adopt police prevention mechanisms. Accordingly, due to the importance of the issue and it’s emerging in Iranian criminal justice system this study Deal with legislative developments in relation to the juvenile police in the international arena as well as in Iranian and America legal system.
