حمايت از كودكان در سازوكارهاي قضايي و غيرقضايي و تعقيب كيفري نقض حقوق آنان

Protection of Children in Judicial and Non Judicial Mechanisms of Criminal Prosecution of Violation of Their Rights

جرايم امروزي به بدترين شكل ممكن كودكان را مورد خشونت و سوء استفاده قرار مي‌دهند. تعهد به پايان دادن به مصونيت در برابر جرايم ارتكابي عليه كودكان، به ويژه از طريق اتخاذ اقداماتي توسط محاكم كيفري بين‌المللي به عنوان سازوكارهاي قضايي و كميسيون‌هاي حقيقت‌ياب به عنوان سازوكارهاي غيرقضايي از طريق تمركز بر تجارب كودكان و درگير كردن آنها با كار خود، ضروري است. با تأسيس ديوان بين‌المللي كيفري و دادگاه ويژه و كميسيون حقيقت‌ياب سيرالئون، براي همۀ كساني كه در زمينه‌هاي حقوق كودك و دادگستري كيفري بين‌المللي فعاليت مي‌كنند اين فرصت فراهم شد تا به شناسايي جرايم ارتكابي عليه كودكان و پايان دادن به مصونيت و بي‌كيفرماني كمك كنند. در اين پژوهش ما ضمن بيان خشونت‌هاي ارتكابي عليه كودكان، به بررسي اين امر مي‌پردازيم كه تا چه ميزان به حمايت از كودكان از طريق سازوكارهاي قضايي از جمله محاكم كيفري بين‌المللي و تركيبي، و سازوكارهاي غيرقضايي از جمله كميسيون‌هاي حقيقت‌ياب كه براي تعقيب نقض حقوق آنان وجود دارد، توجه شده است. فقدان چنين پژوهش‌هايي در زمينه حقوق كودك علي‌رغم اهميت آنها كاملاً ملموس است. حمايت از كودكان در سازوكارهاي قضايي و غيرقضايي از جمله موضوعات مهمي در حقوق بين‌الملل است كه مطالعات علمي در اين زمينه لازم و ضروري است.

Today’s crimes target children for the worst possible violence and abuse. It is our shared duty to protect of children’ rights.. There is a need to strengthen the commitment to end impunity for crimes committed against children, in particular by adopting concrete measures to encourage international criminal justice as a judicial mechanism and truthseeking mechanisms to place more emphasis on the experiences of children and to involve children in their work. With the establishment of the International Criminal Court, the ad hoc Tribunals, and the Special Court and the Truth and Reconciliation Commission for Sierra Leone, there is an opportunity for all those working in the areas of children’s rights and international criminal justice to ensure that crimes committed against children are being addressed. to end to impunity for crimes against children we should sure that accountability mechanisms address crimes against children, through investigation of crimes, prosecution of perpetrators and redress for the victims; Develop childfriendly procedures for children’s involvement in truth and justiceseeking mechanisms. The lack of such papers is obvious. Protection of children in judicial and non judicial mechanisms is the one of the important issues at international law that theoretical studies are necessary in this case.
