Assessing Effectiveness of Testimony Psychology in Scientific Procedure of Tehran City Courts

اين مقاله با هدف تبيين تأثير يافته‌هاي روانشناسي بر اعتبار شهادت شهود و بررسي رويه عملي دادسراهاي شهر تهران در اين خصوص به ارائه شاخص‌ها و معيارهايي براي ارزيابي اعتبار شهادت شهود مي‌پردازد. پرسش اصلي اين پژوهش عبارت است از اينكه؛ يافته‌هاي روانشناسي چگونه مي‌تواند بر نظام ارزيابي اعتبار شهادت شهود تأثير‌گذار باشد. روش به كار گرفته‌شده در پژوهش حاضر به شيوه كتابخانه‌اي و ميداني و با استفاده از ابزارهاي فيش‌برداري و پرسش‌نامه مي‌باشد. جامعه آماري اين پژوهش، كليه قضات دادسراهاي شهر تهران هستند و نمونه آماري، 30 نفر از قضات دادسراها هستند كه به روش نمونه‌گيري تصادفي انتخاب شده‌اند. اطلاعات جمع‌آوري‌شده با استفاده از آمار توصيفي و استنباطي و با آزمون‌هاي پارامتري يا ناپارامتري توسط نرم‌افزار spss مورد تجزيه و تحليل قرار گرفته است. يافته‌هاي پژوهش حاضر نشان مي‌دهند كه با استفاده از يافته‌هاي روانشناسي مي‌توان به شاخص‌هاي معتبري در خصوص ارزيابي اعتبار شهادت شهود دست يافت. همچنين آزمون‌هاي آماري گوياي اين موضوع است كه قضات دادسراهاي شهر تهران از برخي از شاخص‌هاي روانشناسي در ارزشيابي اعتبار شهادت شهود پيروي نمي‌كنند.

The aims of this article is to explain the impact of psychological findings on intuition testimony credibility and assessing scientific procedure of Tehran City courts, in this regard To provide indicators and criteria for assessing ting the testimony credibility. The main question of this study is that how can psychology findings affect the assessment system of credibility. The method used in this research is library and field method and by means of testimony taking and questionnaire. The study statistical population included all judges in Tehran courts and statistical sample are 30 people from courts judges who were selected using random sampling method. Information collected using descriptive and inferential statistics and parametric or nonparametric tests analyzed by SPSS software. The findings of this study show that using psychology findings, can be reached to reliable indicators to assess testimony credibility. In addition statistical analysis indicates that the judges of Tehran prosecutor's offices not follow some psychology indicators in assessing intuition testimony credibility.
