Theoritical Bases of the Liability of Sea Oil Pollution

توسعه پايدار منابع نفت و گاز در فراساحل مستلزم مديريت صحيح زيست‌محيطي در طول عمليات اكتشاف و توليد نفت‌وگاز، حمل‌ونقل و جابه‌جايي آن است و نتيجه عدم مديريت صحيح نشت و ريزش نفت‌وگاز در آب دريا بوده كه به آلودگي، خسارات سنگين زيست‌محيطي و در نهايت، به مسئوليت منجر مي‌شود. مسئوليت فوق مي‌تواند در قالب پيشگيري از آلودگي و در صورت عدم پيشگيري، مسئوليت مدني آلوده‌كنندگان مطرح شود. مباني مسئوليت ناشي از آلودگي نفتي درياها يكي از مباحث عمده حقوق نفت‌وگاز است. مقاله حاضر مي‌كوشد مباني نظري مسئوليت فوق را در اسناد حقوقي بين‌المللي بررسي كند.

Sustainable oil and gas resources development requires proper managing of environment during their exploration and production, offshore operations and transportation. The consequence of improper management in oil and gas exploration, development, production and transportation can be leakage of oil and gas in seas, and may lead to damage and therefore liability.This liability may be brought up in form of prevention, compensation or otherwise, in the form of polluter#039;s civil liability.Theoretical bases of this liability are the major topics in the petroleum law. This article intends to analyze theoritical bases of this liability in the domestic law and intermational instruments.
