تاثير عوامل فراقانوني و قانوني خاص بر تفاوت آرا در تعيين مجازات قضايي در جرايم مشابه

Extralegal and Specific Legal Factors to the Different Sentences on Judicial Punishment in Similar Crimes

در اين مقاله عوامل مؤثر بر تفاوت آراي قضات در جرايم مشابه با تأكيد بر جرايم سرقت تعزيري و ضرب و جرح عمدي بررسي شده است. عوامل به دو دستۀ قانوني خاص و قضايي (فراقانوني) منجر به صدور آراي حداكثر مجازات تقسيم شده، عوامل قانوني خاص ناظر بر جرايم سرقت تعزيري و ضرب و جرح  عمدي  است. براي اين مهم پرسشنامه‌اي شامل30 سؤال با طيف پنج‌گزينه‌اي ليكرت طراحي و نظر جامعۀ قضات دادگاه‌هاي عمومي كيفري و تجديد نظر حوزۀ قضايي شهرستان مشهد جمع‌آوري شده است. مقدار ضريب آلفاي كرونباخ 922/0، حاكي از پايايي بالاي پرسشنامه كه بر شفافيت و پيوستگي سؤالات دلالت دارد، است. چهار آزمون در تحليل استنباطي داده‌ها به‌كار گرفته شده است. براي بررسي تفاوت آرا، از شاخص واريانس نمونه و براي آزمون تعميم‌پذير بودن نتايج از آزمون آماري لون، و از آزمون t براي بررسي مؤثر بودن عوامل احصاشده و از آزمون فريدمن براي رتبه‌بندي ميزان تأثير عوامل مذكور استفاده شده است. نتايج نشان داد كه تأثير عوامل قضايي (فراقانوني) در صدور آراي متفاوت در جرايم مشابه در جامعۀ آماري قضات مورد مطالعه بيش از عوامل قانوني خاص است. در حوزۀ سرقت «مسلح بودن سارق» بيشترين و «سرقت از طريق كيف‌زني و جيب‌بري» كمترين تأثير را در تعيين حداكثر مجازات دارد. «استفاده از اسلحه و چاقو و امثال آن» بيشترين تأثير را در تعيين حداكثر مجازات ضرب و جرح دارد. عامل فراقانوني «طرح‌ريزي قبلي براي ارتكاب جرم» تأثير معناداري بر تعيين حداكثر مجازات توسط قضات دارد.

In this paper, the factors influencing the to the different sentences of the judges in similar crimes with emphasis on intentional crimes, Robberies and Intentional Assaults is considered. Two special legal and extralegal factors leading to the issuance of different sentences divided by the maximum penalties and specific legal factors concerning the crimes of Robberies and Intentional Assault.The questionnaire consisted of 30 questions with a range of important fiveoption Likert design and Comments judges of the court of first instance (Magistrates) and Court of Appeals of the Mashhad city jurisdiction is collected. 0.922 Cronbach's alpha coefficient, indicating the reliability of the questionnaire. To study the difference in sentences, the variance of the sample and to test the generalizability of the results of statistical analysis of Leuven, and the t test for evaluating the effectiveness of the registration agents and the Friedman test was used to rank the factors mentioned above. The results showed that the influences of extralegal factors in different sentencing issued by judges in similar crimes are more than the specific legal factors. Theft of "being armed robbers," most affected and "Wallet theft" has minimal effect .On the maximum penalty. " Use guns , Knife and etc," has the most influence in determining the maximum punishment of Intentional Assault. Extralegal factor "plan prior to the offense" has a significant effect on the maximum penalty by the judges.
