تسري حكم اخبار علاجيه به حوزه تعارض قرايات از منظر فقيهان و اصوليان شيعه

Extending the Judgment of ‘Alājīyah Traditions to the Conflict of Readings (Qarā’āt) from the Viewpoint of the Shi’ite Jurists and Legal Theoreticians (Uṣūlīs)

اختلاف قرايات، گاه به تعارض حكم مستفاد از آيه مي‌انجامد. اين تعارض، در حوزه‌ روايات نيز مشاهده مي‌شود با اين تفاوت كه شيوه‌ تعامل با روايات متعارض، از اخبار علاجيه به دست مي‌آيد. مساله‌ قابل طرح آن است كه آيا قواعد به دست آمده از اخبار علاجيه به حوزه‌ تعارض قرايات نيز راه پيدا مي‌كنند؟ در اين صورت، چه پيش‌شرط‌هايي براي راهيابي اين قواعد به حوزه‌ تعارض قرايات وجود دارد؟ رويكرد اصوليان و فقيهان شيعه به اجراي اين قواعد بر حوزه تعارض قرايات چگونه بوده است؟ اين مقاله كوشيده است از راه بررسي شرايط لازم براي اجراي قواعد اخبار علاجيه در مورد قرايات متعارض، چگونگي پياده‌ كردن اين قواعد در حوزه‌ تعارض قرايات را بررسي كند. به نظر مي‌رسد حل تعارض دو قرايت نيز همچون دو روايت متعارض به اخبار علاجيه سپرد شده و بنا بر مورد، قواعد موجود در اين اخبار در مورد دو قرايت متعارض نيز قابل اجرا است. بر اين اساس، جمع، ترجيح، تساقط و تخيير، راهكارهايي است كه به حوزه‌ تعارض قرايات امكان ورود دارد. با اين حال، فقهاي شيعه با رعايت جانب احتياط، اين راهكارها را در كنار ديگر ادله‌ فقهي و به عنوان مويد، مورد توجه قرار داده‌اند.

Sometimes disagreement in regards to reading a Qur’?nic verse has resulted in a paradoxical judgment and this occurs in traditions, as well. But the way in which one can consider paradoxical verses arises from the so-called ‘Al?j?yah traditions. The question that arises here is as follows: can the rules presented by these evidences be also extended to the paradoxical readings? If so, what are their preconditions? What was the Shi’ite u??l?s and jurists’ approaches towards these rules in regards to paradoxical readings? This research tries to explain necessary conditions of the rules of ‘Al?j?yah traditions concerning paradoxical readings and how to implement these rules in paradoxical readings. The solution of two conflict readings like that of conflict traditions has been considered on the basis of ‘Al?j?yah traditions. Thus, combination, preference, and adoption are some solutions which have been entered to conflict readings by u??l?s. Shi’ite jurists, however, have shown caution and considered these solutions along with other juridical reasons.
