قرارداد مزارعه ميان بيش از دو نفر، موضوعي اساسي در فعاليت‌هاي اقتصادي است كه در اين مقاله سعي خواهد شد موضوع بر اساس نگاه توسعه‌محور اسلام بررسي شود. در نوشتار حاضر دو ديدگاه موافق و مخالف در باب مزارعه ميان بيش از دو نفر مطرح شده است كه اين مقاله ديدگاه موافق را با توجه به دلايلي مانند عمومات و اطلاقات كتاب و سنت و همچنين دلايل خاصي كه در باب مزارعه ذكر شده‌اند، با روش توصيفي - تحليلي تقويت مي‌كند؛ زيرا اجتهاد پويا، موضوعيت خاصي در اداره جامعه دارد و اقتضا مي‌كند كه اين عقد با توجه به مجموعه دلايل نقلي قوي، به دو نفر محدود نباشد و گستره‌اي فراتر از دو نفر را در بر گيرد. ادله روايي مخالف مزارعه ميان بيش از دو نفر بر موارد غالبي حمل شده و ادله‌اي مانند توقيفي و تركيب معامله از ايجاب قبول، بدون دليل است كه در مقابل عمومات كتاب، سنت و ادله خاصه باب مزارعه جايگاهي ندارد. در نهايت با توجه به نگرش توسعه‌‌محور فقه در فعاليت‌هاي اقتصادي، جواز مزارعه ميان بيش از دو نفر را اثبات مي‌كنيم.

Farming partnership contract among persons is a basic issue in economic actions that the article is going to review it based on the view of the development of Islam’s axis. In the current essay, two favorable and unfavorable vantage points on farming partnership among persons are brought up that this article is going to strengthen the favorable viewpoint regarding the proofs like generalities and wholes of the Book and Tradition and also specific reasons mentioned on farming partnership using the descriptive-analytical method; because the dynamic Ijtihad is of a particular topicality in managing the society and requires consisting of a domain beyond two persons and unlimited according to a set of strong transmitted proofs. The traditional evidence which is against the farming partnership among persons has taken the majority of cases into consideration, whereas, the evidence like the confiscatory one and consolidating the transaction out of offer and acceptance is of no reason that it is of no state against the wholes of the Book and Tradition and property evidence on farming partnership. Finally, the farming partnership among persons is proved according to the development-oriented attitude of the canon law in economic activities.
