نقض حقوق مالكيت ادبي و هنري با استفاده‌ طنزگونه از آثار ادبي و هنري ديگران

The Uses of Satire from Literary and Artistic Works of Others; a Discussion Copyright Infringement

گروهي از آثار طنز براساس شوخي و مطايبه با آثار ادبي و هنري كه پيش‌تر خلق‌ شده‌اند، شكل مي‌گيرند. از آنجا كه اين امر به نسخه‌برداري و تغيير اثر ديگري منجر مي‌شود، از مصاديق نقض حقوق مالكيت ادبي و هنري تلقي مي‌شود. ماده 6 مكرر كنوانسيون برن، تغيير اثر ديگري را در صورت لطمه به حيثيت و شهرت مؤلف برنمي‌تابد و به‌موجب بند 1 ماده 9 نيز، تكثير اثر بدون اجازه مؤلف امكان‌پذير نيست. بنابراين، مقاله حاضر تلاش مي‌كند با روش تحليلي توصيفي تعارض استفاده طنزآميز با حقوق انحصاري ناشي از حقوق مالكيت ادبي و هنري اثر قبلي را بررسي كرده و راه‌حل‌هاي مقتضي را براي برون‌رفت در دعاوي مرتبط پيشنهاد كند. به‌طور كلي، آثار طنز با هويت مستقل كه داراي درجه‌اي از اصالتند و قصد تخريب يا استهزاء مؤلف اثر نخستين را نداشته و بازار اثر اخير را نيز تضعيف نمي‌كنند، مي‌توانند از اتهام نقض عبور كنند.

Some satire works is based on the fun and humor with the work of others that have already been created. Since it would lead to repudiation and change work is an example of copyright infringement. In accordance with Article 6 bis, the author shall have the right to object to any distortion, mutilation or other modification of, or other derogatory action in relation to, the said work, which would be prejudicial to his honor or reputation. Also, the reproduction without permission of the author  is not allowed (Art.9 (1)). According to the descriptive analytical method, this paper attempts for examine this challenge and suggests possible solutions for overcoming a major legal problem. In general, the satire works of independent identity that did not intend to damage or mockery the first author and not undermine the market is also charged to copyright infringement less.
