The Cultural Rights in International Human Rights Law; Reduced Speed in a Demanding Context

حقوق فرهنگي طيف وسيعي از حقوق انساني را شامل مي‌شود. بسياري از حق‌ها و آزادي‌هاي انساني يا در مجموعه حقوق فرهنگي قرار دارند و يا براي تحقق صحيح آن‌‌ها به حقوق فرهنگي نياز است. همچنين تحقق بسياري از حق‌ها به صورت غيرمستقيم با حقوق فرهنگي پيوند دارد. به همين جهت، بسياري از مصاديق حقوق فرهنگي به‌منزله مبنا و بنياد بهره‌مندي از ساير حقوق‌‌بشر قلمداد مي‌شوند. با همه اهميت حقوق فرهنگي، نظام بين‌المللي حقوق‌بشر در اين حيطه علي‌رغم پشت سر نهادن روندي پر اُفت و خيز براي كامل شدن، نه تنها هنوز اميدهاي بسياري را پاسخ نگفته، بلكه نگراني‌هاي متنوعي را نيز دامن زده است. در مطالعات روزافزون حقوق‌بشر در سراسر دنيا همچنان سهم بررسي‌هاي مربوط به حقوق فرهنگي و شكل‌گيري فكر و انديشه در اين زمينه مطلوب نيست و پرسش‌هاي متعدد بي‌پاسخ باقي مانده است. نوشتار حاضر با ملاحظه مهم‌ترين اسناد بين‌المللي ذيربط و تحقيقات علمي جهاني در حيطه حقوق فرهنگي، كوششي است با اين هدف كه روند شناسايي حقوق فرهنگي را در نظام بين‌المللي حقوق‌بشر مشخص سازد، نكات محوري مربوط به حقوق فرهنگي را در نظام بين‌المللي حقوق‌بشر بيان كند، عناصر حقوق فرهنگي را از يكديگر تفكيك نمايد و مبتني بر بررسي‌هاي ياد شده، به طور فشرده روشن سازد كه چه فرصت‌ها، چالش‌ها و موانعي فراروي تحقق حقوق فرهنگي در جهان معاصراست. ارائه پيشنهاد و توصيه‌هاي نظري و كاربردي براي باروري هر چه بيش‌تر مباحث حقوق فرهنگي در فرايند تلاش‌هاي آتي، رهاورد مقاله حاضر است.

The cultural rights encompass a wide scope of human rights. Many elements of human rights are categorized within cultural rights and others are somehow associated or indirectly dependent to them. In fact, many instances of cultural rights are assumed as the basis and foundation for the enjoyment of other human rights. Despite the importance of cultural rights, international human rights system (although passing a challenging process toward culmination) has not only responded to expectations but also created various concerns. The portion of cultural rights and formation of thoughts in this regard is not satisfactory within the international human rights studies, and many issues are disregarded.This paper, reviewing the main international instruments and scientific human rights researches, makes an effort to identify the process of recognition of cultural rights in the international human rights system to declare the significant issues of cultural rights in international human rights to distinguish the cultural rights elements and, based on the aforementioned studies, to clarify the achievements and challenges of implementation of cultural rights. The paper will be concluded with some theoretical and practical suggestions and recommendations for future studies.
