حمايت از زنان قرباني ترور در حقوق بين‌الملل: در پرتو مفهوم نظم اجتماعي و بين‌المللي

Supporting Women Victims of Terrorism in International Law: In the Light of Social and International Order

در بررسي حوادث تروريستي و توجه به حقوق زنان بزه‌ديده، با نقض گسترده و روزافزون حقوق بنيادين و تثبيت‌شده آن‌ها مواجه هستيم. درحالي‌كه حل مشكلات آن‌ها مهم‌ترين بخش اقدامات ضدتروريستي است اما نه‌تنها اين معضلات رفع نشده است، بلكه زنان قرباني، دچار ظلم مضاعف هم مي‌شوند. بر همين اساس سؤال اصلي تحقيق حاضر اين است چرا در جهان امروز باوجود انجام برخي اقدامات حقوقي در سطح بين‌الملل، اهتمام لازم در رفع عوارض مستقيم و غيرمستقيم ترور در مورد زنان و برقراري حقوق بنيادين آن‌ها مشاهده نمي‌شود؟ چرا هرسال با رشد چشمگير اين‌گونه خشونت‌ها مواجه هستيم؟  در پاسخ به پرسش بالا، اين نوشتار با استفاده از روش كتابخانه‌اي (توصيفي تحليلي)، ضمن بررسي قواعد ماهوي درصدد كشف نقاط ضعف و قوت حقوق بين‌الملل برآمده است. براساس نتيجه حاصل از اين پژوهش، نظم حقوقي مناسب براي حمايت و تأمين حقوق زنان كه در ماده ۲۸ اعلاميه جهاني حقوق بشر بر آن تأكيد شده، فراهم نشده است؛ بنابراين تقويت بنياني‌ترين نهاد جامعه بشري يعني خانواده اولويت اول حقوق زنان است. هم‌زمان نيز بايستي ساختارهاي ملي و بين‌المللي متناسب با آن متحول گردد. در اين جستار پس از تبيين حقوق تضييع‌شده زنان قرباني ترور در حقوق بين‌الملل، به نقش محوري نظم بين‌المللي و اجتماعي لازم براي تحقق آن اشاره شده است.

In reviewing terrorist incidents and considering women victim’s rights, we are facing massive and increasing violations of their fundamental and established rights. While solving their problems is the most important part of counterterrorist measures, however this problem not only is this problem resolved, but rather women victims are also suffering great oppression. Accordingly, the main research question is that, why in today’s world in spite of some legal actions at international level, the necessary steps to fix the direct and indirect complications of terrorism on women and their fundamental rights are not taken? Why are we facing dramatic growth of such violence every year? In answer to the above question, this article by using library method (descriptive analytical) while investigating the substantive rules, tries to discover the strengths and weaknesses of international laws. Based on the results from this research, the suitable legal order to support and ensure the rights of women, which is emphasized in Article 28 of the Universal Declaration of Human Rights is not provided. So strengthening the basic entity of human community i.e. the family is the first priority of the women's rights. At the same time domestic and international structures need to be transformed. In this paper, after explaining the ignored rights of women victims of terror at international law, the pivotal role of social and international order necessary for its realization have been mentioned.
