راه‌هاي تعدي از نص، بررسي عليت و ملاكات احكام و سازوكارهاي كشف مقاصد شريعت، گفتماني است براي پويايي شريعت كه با دگرگوني موضوعات و تغيير در احوال و شرايط اجتماعي، چگونگي تغييرات در احكام را مشخص مي‌كند. البته فهم‌پذيري غايات احكام، هرچند سبب بالندگي فقه است، ولي بدون ضابطه نيست. نوشتار حاضر، با بررسي نظرهاي فقهاي شيعه، ضمن تبيين مقاصد شريعت و ادلۀ اثبات مقاصد با ادلۀ نقلي و عقلي، روش‌هاي كشف مقاصد شريعت را بررسي مي‌كند كه عبارتند از: روش استقرا، روش فهم علل اوامر و نواهي، مجرد امر و نهي ابتدايي، استفاده از تعبيرات و روش استفاده از سكوت شارع با وجود مقتضي و نبود مانع.
