عدم نفوذ، ضمانت ‌اجراي فقدان برخي از شرايط اساسي صحت معاملات است و به‌طور معمول در عقود فضولي، اكراهي و برخي از قراردادهاي محجورين مطرح مي‌شود. بر اساس اين وضعيت حقوقي، قرارداد، فاقد اثر بوده و سرنوشت آن به الحاق بعدي رضاي معتبر (اجازه) يا اعلام رد توسط ذي‌نفع وابسته است. اين وضعيت به‌طور معمول در عقود به رسميت شناخته شده، ليكن نظر مشهور، عدم پذيرش آن در ايقاعات است. با اين همه مسئله اين است كه آيا ادلۀ نظر مشهور، توانايي توجيه تبعيض ميان عقد و ايقاع از اين جنبه را دارد؟ در اين جستار با رويكردي فقهي حقوقي و با روشي توصيفي تحليلي، در صدديم تا از سويي به تبيين و نقد ادلۀ پذيرفته نشدن عدم نفوذ در ايقاعات بپردازيم و از سوي ديگر، نظريۀ پذيرش عدم نفوذ در ايقاعات را تحليل و سعي در اثبات آن مي‌كنيم.

This situation has been normally known as formal in contracts; but famous opinion is rejection of that in unilateral acts. However, the question is that if the reasons of famous opinion have the ability to justify the difference between the contract and unilateral act by this point? This article with juridicallegal approaching and with the descriptive analytical method is seeking to explain and criticism the reasons of rejection of Uninfluenced in unilateral acts and on the other side, it is Analyzing the theory of accepting the Uninfluenced in unilateral acts and tries to proof it.
