( Comparative Study of Laws and Government Development Programs in the Field of Family ( Case of Study: Iran and Malaysia

هدف اصلي اين مقاله مطالعه تطبيقي قوانين و برنامه هاي توسعه اي دولت در حوزه خانواده در كشورهاي ايران و مالزي است. همانطور كه دولت ها مي توانند از ظرفيت هاي ناب خانواده در افزايش مشاركت هاي سياسي و اجتماعي بهره مند شوند با توسل به شيوه هاي مستقيم و غير مستقيم بر اقتدار اين نهاد بيافزايد و با اجتناب از انضمامي پنداشتن آن و توجه مستقيم به خانواده بستر رشد و ارتقاء خانواده را فراهم و بدين سان تعهدات خود را به نحو مطلوب ايفاء نمايد. علاوه بر آن درك بهتر اين نهاد عليرغم تنوع رويكردهاي سياسي با در نظر گرفتن هويت مستقل و رعايت حريم خانواده محتوم و قطعي مي باشد. تدبر در ساز و كارهاي عمومي و نحوه عملكرد تقنيني و سياستي متصديان حكومت با عنايت به هنجارهاي پذيرفته شده قانوني دولت ها در خصوص تعهدات ريز و درشت آنها در قبال «خانواده» از جهت آسيب شناسي گزاره هاي ياد شده و كشف الگويي قوام يافته به منظور برقراري ارتباطي سازنده و غير منفعل از سوي دولت و خانواده راه گشا خواهد بود. در اين جستار سعي گرديده تا با تمركز بر شاخصه هاي معروف نزد جامعه بين المللي و خرد جمعي در حوزه حكمراني، آثار آنها را بر موجوديت خانواده مورد ارزيابي قرار گيرد.

Abstract: The main objective of this paper is a comparative study on family law and government development programs in Iran and Malaysia. As governments can increase the capacity of the quintessential family benefit in social and political participation which is done by resorting to the direct and indirect ways to increase the authority of the institution and to avoid assuming the concrete and direct attention to the growth and promotion of the family to provide families and thus their obligations to provide appropriate play. In addition, despite the differences in political attitudes, understanding with regard to the identity and privacy of the family is inevitable and irrevocable. Reflection on construction and public works, and how the law and government policy officers do with regard to the accepted norms of state law and big and small obligations towards "family" would be helpful considering the statements mentioned in pathology and discover the consistency of the findings in order to communicate constructively and presenting a non-passive model of the state and the family. In this paper, we tried to focus on factors known to the international community and the collective wisdom in the field of governance. Their works were evaluated on the existence of the family
