كاركرد زندان از منظر نظريه‌هاي جامعه‌شناسي مجازات

The Function of Prison from the Perspective of the Theories of the Sociology of the Punishment

پس از ظهور زندان در اوايل قرن نوزدهم ميلادي، روشنفكران و متخصصان عدالت كيفري به اين مجازات نوپا بسيار خوش‌بين بودند. زيرا در تقابل با مجازات‌هاي قبل از آن، انسان‌دوستانه جلوه مي‌نمود؛ اما ديري نپاييد كه انتقادها نسبت به آن آغاز شد. زندان‌ها از همان بدو تأسيس با مسائل فراواني روبه‌رو بودند و با گذشت زمان، مشكلات نمود بيشتري يافتند. امروزه جمعيت زندان‌ها به يك بحران جهاني تبديل شده و راهكارهاي فيلسوفان و كيفرشناسان براي حل معضلات اين مجازات، راه به جايي نبرده است. زندان علاوه بر اينكه در تحقق اهدافي چون اصلاح و تربيت مجرمان و همچنين كاهش آمار جرايم موفق نبوده، خود نيز تبديل به يك معضل شده است. سؤال اساسي اين است كه چرا به رغم مشكلات موجود، نظام‌هاي عدالت كيفري بر استفاده از زندان پافشاري دارند؟ به نظر مي‌رسد بايد از زاويه‌اي ديگر به مجازات‌ها به طور كلي و زندان به طور اخص نگريست. ادعاي نوشتار حاضر آن است كه تجزيه و تحليل مجازات زندان در بستر جامعه‌شناسي كيفر مي‌تواند كليد حل بسياري از معماهاي موجود باشد. در اين راستا سعي مي‌شود تا چرايي استمرار زندان از منظر ديدگاه‌هاي مختلف اين رشته مورد بررسي قرار گيرد. طبق اين رويكردها، زندان به عنوان نهادي تلقي خواهد شد كه به سبب كاركردهاي ويژه‌اي كه دارد تداوم مي‌يابد؛ هرچند از نظر انديشه‌هاي فلسفي و كيفرشناسانه در اهداف پيش‌فرض خود عملاً شكست خورده باشد.

after establishing prison in the early 19th century, the intellectuals and experts of the criminal justice were so optimistic about this new punishment. It seemed humanitarian in comparison to the former punishments, but it did not last long that the criticisms about it were started. Prisons from the beginning confronted problems and the passing of time, the difficulties became more visible. Today, the prison population has generated a global crisis and the philosophers and criminologists’ strategies to solve this difficulty have not created consequences. Besides prisons not being successful in achieving their results like educating and rehabilitative programs and also the crime rate reduction, they have also changed into a problem. Because of existent difficulties, the main question is why the criminal justice systems insist on using prisons. It seems that it should be observed punishments especially prison penalties from the other angle. The present paper is to analyze and examine the prison penalty can be the solution key for a lot of existent problems from a criminalsociological view. It tries to study the reasons of the continuity of prisons from the different attitudes. Based on these approaches, they regard as an institution that they continue for their specific functions; although they are practically failed to achieve their considered goals from the point of the philosophical and criminological view.
