قانون اساسي جمهوري اسلامي ايران، بر اساس ماهيت انقلاب اسلامي، براي كرامت انساني، بهاي ويژه اي قائل شده است تا جايي كه مي توان گفت: در مقايسه با قانون اساسي كشورهاي ديگر، يك قانون اساسي «ارزشي» محسوب مي شود؛ بدين معنا كه قانون اساسي جمهوري اسلامي ايران بر شالوده كرامتي كه از ناحيه اعتقادات ديني حاصل مي شود، بنا شده و هدف آن ايجاد بستر مناسب براي شكوفايي استعدادها و نيروهاي مثبت در وجود آدمي براي نزديك شدن به خدا مي باشد؛ چرا كه خواست عمومي مردم ايران تدوين قانون اساسي براساس موازين اسلامي بود و همچنين كرامت انساني نيز يكي از اصول غيرقابل انكار اسلام است. اما پرسش اساسي اين است كه «قانون اساسي جمهوري اسلامي ايران كه مبين حقوق اساسي ملت ايران است، تا چه ميزان خود را متعهد به تضمين و رعايت كرامت انساني نموده است؟» به نظر نگارنده كرامت ذاتي به عنوان بن مايه كرامت انساني به صورت يك قاعده حقوق اساسي، در قانون اساسي جمهوري اسلامي، پذيرفته شده و در اصول متعددي از آن تجلي پيدا كرده است.

Based on the nature of Islamic Revolution، Constitution of Islamic Republic of Iran has given a special magnitude for dignity in its valuably concept، insofar as we can say: In comparison with other countries’ Constitution، It is a “valued” Constitution ; Thus the Constitution of Islamic Republic of Iran Is built on the dignity made by religious beliefs and its purpose is to develop an appropriate circumstances for flourishing talents and positive forces in human nature in order to approaching God; because the public demand of the people of Iran was to codify Constitution based on the Islamic criteria and also human dignity is one of the undeniable principle of Islam ، but the main question is : to what extent the Constitution of Islamic Republic of Iran which is an expression of fundamental rights of the nation of Iran is committed to ensuring and considering the human dignity? In the opinion of the author، Inherent dignity as basis of human dignity is adopted as a rule of fundamental rights in the Constitution of Islamic Republic of Iran and has been expressed in a number of its principles.
