A Research on Sources, Methods of Argument and Merits and Demerits of the Hanafite School of Uṣ ūl

مكتب فقها از مكاتب مشهور اصولي به ويژه در ميان احناف است. در اين مكتب به روشي استقرائي مسائل و قواعد اصولي از فروع فقهي استنباط ميشود. شايد علت گرايش به اين مكتب، عدم وجود منبع اصولي از ائمه حنفي بوده است. آغاز كار اين مكتب را م يتوان به نيمه هاي قرن سوم هجري برگرداند. اثبات و تقرير قواعد به مقتضاي فروع منقول از ائمه مذهب، التزام به مذهب در قواعد و اصول استنباطي، تنوع و تازگي مثا لها، ساختن يك قاعده اصولي از فرع فقهي يا تغيير آن به خاطر وجود يك فرع فقهي معارض، عملي و كاربردي كردن قواعد اصولي، وجود مصداق فقهي براي مباحث اصولي، آسان نبودن مطالعه، تحقيق و جستجو در كتب مكتب، اثبات و تقرير قواعد به مقتضاي فروع منقول از ائمه مذهب از مه مترين ويژگي هاي اين مكتب اصولي است. ضعف روش بحث و استنتاج قواعد اصولي در اين مكتب، موجب شده است كه اين روش اصولي تا حدي منسوخ شود.

The school of jurists or the Hanafites is one of the most famous schools especially among the Hanafites. In this school, questions and principles are derived from juridical minutiae deductively. Perhaps the tendency of these scholars to this school was the lack of reliable source from Hanafite scholars. The dawn of this school can be traced back to the third century. The most notable features of this school are: confirmation of the principles based on the minutiae transmitted from schools' leaders, the obligation to school in deduction, versatility and novelty of examples, deducing principles from juridical minutiae or altering them because of contradictory minutiae, making principles practical, and complexity of study. Weakness in method of deduction of principles in this school has caused this approach somehow to begin to become obsolete.
