A Review of the Documents Governing the International Air Transport Rights and the Responsibilities of the Air Transport Operators

اين مقاله به بررسي اسناد و مدارك مورد نياز در حمل و نقل هاي هوايي بين المللي و مسئوليت متصديان در كنوانسيونهاي ورشو، مونترال، گوادالاخارا و پروتكل لاهه پرداخته است. ابتدا مشخص مي گردد كه مقررات حمل ونقل هوايي اعم از مسافر و كالا و بار همراه چگونه پديد آمد و منتج به پيدايش كنوانسيونهاي هوايي گرديد و اين كنوانسيونها باعث يكپارچگي مقررات صنعت حمل ونقل هوايي، و تضمين خسارات جاني و مالي مسافران و بار همراه آنها و كالاهاي تحويلي به متصدي حمل و نقل و راه هاي جبران خسارات و ميزان پرداختي بر اساس مدارك و دادگاه هاي صالحه جهت طرح دعوا مي پردازد.

This paper examines the documents required in international air transport and the operators' responsibilities in the Warsaw Convention, Montreal Convention, Guadalajara Convention and the Hague Protocol. First, it dealt with how the air transport regulations including regulations about passengers, cargo and baggage were developed and resulted in the emergence of the air transport conventions, and how these conventions helped integrate the air transport industry regulations and ensure the passengers' damages and losses and carry-on baggage and goods delivered to the transport operators, and then discussed different ways of compensation and the amount of payment based on the evidence and the competent courts where actions may be brought.
