The Position of Khiyar Aib despite Guarantee

خيار عيب يكي از خيارات كاربردي در بين موارديست كه فقه و به طبع آن قانون مدني در اختيار طرفين معامله جهت احقاق حق از معيوب بودن مورد معامله قرار داده است. امروزه بر اين خيار حقي نيز انضمام يافته كه به موجب آن تعهد بر رفع عيب و يا هرگونه احقاق حق شايسته از طرف متضرر بر عهده ي طرف ديگر استقرار مي يابد؛ اما استدلال مخالف برخي؛ از امر گارانتي، رضايت زيان ديده را ميرساند و خود را از باب هرگونه عيب و مسئوليتي راجع به آن مبري ميدانند. در اين مقاله كه به صورت توصيفي تحليل و با تكيه بر مواد قانون و نيز منابع كتابخانه اي تدوين شده، به سوالاتي از جمله ماهيت حقوق گارانتي و حقوق زيان ديده در موارد گارانتي در قوانين داخلي پرداخته شده. نتايج اين تحقيق بيان گر آن است كه حضور گارانتي هيچ باري از دوش فروشنده ي كالاي معيوب بر نميدارد و از طرفي نيز آن را با تعهدي مضاعف روبرو ميسازد.

Khiyar Aib (option of defect) is an option that Jurisprudence and the civil law have considered for the parties to a transaction to restore rights to defective goods. Today, a right has been added to this option, according to which the other party has an obligation to remove the defect or restore the rights of the aggrieved party. However, some argue against guarantee and in favor of the injured party's satisfaction, with the other party having no liability for the defective goods. This paper which has used a descriptive-analytical research method has relied on articles of the law as well as library resources to respond questions relating to the nature of the guarantee right and the rights of the party receiving defective goods in domestic law. The results indicate that guarantee does not remove any liability from the seller of defective goods; rather it brings a double obligation to such a seller.
