بررسي اطاله دادرسي در محاكم استان كهگيلويه و بويراحمد و راهكارهاي غلبه آن

Investigating the Prolonging the Legal Proceedings in Kohgiluyeh-boyerahmad Judiciary and the Ways to overcome it

اطاله دادرسي در دادگاه هاي دادگستري يكي از موضوعاتي است كه مخصوصاً در سنوات اخير به لحاظ اهميت و آثار سوء و زيانباري كه دارند براي مراجعين دادگستري و حتي متصديان امر قضاء، اعم ازمديران ارشد قوه قضائيه و قضات و ساير كاركنان اين تشكيلات به يك معضل تبديل گرديده است. تلاشها و اقدامات نسبتاً خوب و مناسبي جهت رفع اين معضل هم از سوي مسئولين قوه قضائيه و هم از سوي بعضي صاحب نظران معمول گرديده وليكن كافي نبوده و مشكل همچنان به قوت خود باقي است و لازم است در اين خصوص تحقيقات بيشتري صورت پذيرد. در اين تحقيق درصدد شناسايي و جواب اين سئوال هستيم كه مهمترين علل و عوامل موثر در اطاله دادرسي در محاكم استان كهگيلويه و بويراحمد كدامند؟ آيا فقط قوه قضائيه مسئول است و يا قواي مقننه و مجريه و ساير نهادهاي غير دولتي هم در اين امر موثر هستند؟ نتيجه تحقيق انجام شده اين است كه اولاً عوامل متعددي در بروز اين معضل دخيل مي باشند. ثانياً اين عوامل ناشي ازايراداتي است كه هم در قواي سه گانه وجود دارد و هم ديگر نهادها از جمله كانونهاي وكلا و كارشناسان رسمي در آن موثر مي باشند. به عنوان مثال مواردي از قبيل كمبود شديد كادر قضايي و اداري و تجهيزات و ملزومات مناسب كاري و تراكم زياد كار در اين استان از علل مربوط به قوه قضائيه بوده و از عوامل مربوط به قواي مقننه و مجريه بايد به نقص و يا خلاء قانوني و عدم آگاهي مديران و متصديان اجرايي و مراجعين به دادگاهها ازقوانين و يا نحوه اجراي صحيح قوانين و دستورات قضايي اشاره كرد و براي رفع آن لازم است اين ايرادات و ابهامات مرتفع گردد و آموزشها و آگاهيهاي لازم هم به مجريان قوانين و هم به ساير مردم داده شود.

Prolonging the legal proceedings in the courts especially in recent years due to seriousness and damages for referrer to judiciary system and even the judicial administers including the high rankings and other staffs of judiciary system has turned to a grand difficulty. Although many relatively good and satisfactory attempts have been initiated by both experts and judicial administers but they are not sufficient and the problem still exists. Therefore, it is necessary that this problem be probed more exactly. So I am a full time Judge in Kohgiluyeh-boyerahmad Judiciary was encouraged by one of respectful mentors to select Prolonging Trial in Kohgiluyeh-boyerahmad Judiciary system as my thesis for master degree. This thesis tried to probe and find solution to these questions! What are the main cause and elements in prolonging trial in Kohgiluyeh-boyerahmad Judicial offices? Whether only Judiciary power involves or other powers such as Executive and legislative powers and non-governmental organizations also are involved. The results of the performed research show that, firstly, many factors are involved in the occurrence of this problem. Secondly, these factors are caused by the defects of the three powers as well as other organizations including Bar Association and Official Appraisers, For example, factors like severe shortages in judicial and administrative staff as well as shortages in the proper equipment and material for work and the heavy workload that existed in this province are related to the judiciary and problems that are related to the Executive and the Legislature include the defects of the rules, the lack of some rules and the unfamiliarity of directors, executive in-charges and clients with rules and the proper method for the operation of the rules and instructions, To solve this problem, it is necessary to correct the defects, remove the ambiguities and provide the executive in-charges as well as people with the necessary training
