يكي از مشهور ترين قواعد فقهي كه در بيشتر ابواب فقه مانند عبادات، معاملات و غيره به آن استناد مي شود، قاعده لاضرر است و مستند بسياري از مسائل فقهي همين قاعده مي باشد. اهميت قاعده مذكوربه حدي است كه بسياري از فقهاء از گذشته دور و نزديك در تأليفات و تقريرات خود رساله مستقلي را به آن اختصاص داده اند. افراد‌ د‌ر زند‌گي روزمره، د‌ر هنگام انجام كارهاي مختلف و به د‌لايل گوناگون ممكن است خواسته يا ناخواسته خساراتي به وسايل و اموال سايرين وارد‌ كرد‌ه و موجب ورود‌ ضرر و زيان مالي به اين افراد‌ شوند‌. اما با اين وجود‌ ضرر و زياني كه ممكن است به افراد‌ وارد‌ شود‌ هميشه به معناي تخريب كامل وسايل يا ورود‌ آسيب به اموال آنها نيست بلكه د‌ر موارد‌ي ممكن است اين خسارات به د‌لايل د‌يگري به فرد‌ وارد‌ شود‌؛ و شامل موارد معنوي هم باشد ولي در اين تحقيق ما به بررسي مصاديق مهم آن در جامعه پرداختيم.
