بررسي و مقايسه قرارداد گشايش اعتبار اسنادي با برخي نهادهاي حقوقي

An Examination and Comparison of the Contract for the Opening of Legal Tender with Some Legal Institutions

درتحليل ماهيت حقوقي توافق متقاضي اعتباراسنادي و بانك گشاينده، بعنوان يكي از اركان مكانيزم اعتبار اسنادي كه در كشور ما موسوم به قرارداد گشايش اعتبار اسنادي است، در ميان نويسندگان رسم بر اين است كه اغلب به مقايسه اين توافق با عقود معين بسنده مي كنند و البته برخي ديگر در كنار اين رسم مالوف اجملأ نيم نگاهي نيز به نهادهايي همچون ماده 10 قانون مدني و يا ايقاع دارند. با اين حال بررسي و مقايسه اين توافق با ساير نهاد هاي حقوقي مانند استصناع و مرابحه كه اخيرأ وارد نظام حقوقي كشورشده اند مغفول مانده از سوي ديگر اين نهاد هاي نورسيده چون فاقد پشتوانه هاي علمي و تحقيقاتي مانند ديگر نهاد هاي مسبوق به سابقه درنظام فقهي و حقوقي ماهستند، كاستي هاي موجود دراين زمينه را دوچندان نموده است، لذا اين پژوهش اختصاص به تطبيق اين توافق با دو تاسيس نوظهور در نظام حقوقي يعني استصناع و مرابحه دارد و در پايان نيز نگاهي دقيق تر به مقايسه آن با ديگر نهاد هاي حقوقي همچون ماده 10 قانون مدني، ايقاع و تعهد به سود ثالث گرديده است، حاصل اين پژوهش بيانگر آن است كه اين نهادها هيچ يك قالبي مناسب براي تبيين حقوقي توافق برگشايش اعتبار اسنادي نيست.

In the analysis of the legal nature of the agreement between the creditor and the issuer's bank, as one of the instruments of the instrument of credit in the country, known as the contract for the development of credit, is one among the writers who often compare this agreement with certain contracts, and some others, in addition to this, also take a look at the institutions as in Article 10 of the Civil Code or Law. Nevertheless, the review and comparison of this agreement with legal entities such as ISSANA and the recently existing state law enforcement agencies have been neglected on the other hand by these undercover organizations, lacking scientific and research support, such as other proposals for legal and legal protection, have made the shortcomings in this area more duplicated. Therefore, this research aims to implement this agreement with two newly established legal systems, namely, social security, at the end of the year it has been carefully compared to other legal entities such as Article 10 of the Civil Code, and it is a commitment to the benefits. That these institutions are not in any way suitable for explaining the legality of the agreement to issue credentials.
