به طور معمول، قائم مقامان را به دو دسته عام و خاص تقسيم مي كنند. كسي كه مجموع دارايي يا بخش مشاعي از آن به وي مي رسد قائم مقام عام ناقل و مالك قبلي محسوب مي شود. در قائم مقامي خاص، تنها با انتقال مال، حق يا اموال معيني رو به رو هستيم كه به واسطه اين انتقال، منتقل اليه جانشين انتقال دهنده در حقوق و تعهدات مربوط به آن مال يا اموال مي گردد و آثار قراردادهايي كه ناقل قبلاً در مورد مال يا حق مورد انتقال با ديگري منعقد نموده، به وي سرايت مي كند؛ كه يكي از دلايل قائم مقامي انتقال گيرنده ارتباط و پيوستگي ميان حقوق و تعهدات با مال مورد انتفال مي باشد. بر اين اساس، مثلا خريدار دربارۀ آثار قراردادهايي كه فروشنده قبل از بيع با ديگران بسته، قائم مقام خاص وي محسوب مي شود؛ و همچنين وارث را قائم مقام مورث در مورد حقوق و تعهدات وي مي شناسد. معني اين گفته آن است كه حقوق و تعهدات قراردادي مورث در قالب دارايي به ورثه او منتقل مي شود. محقق در اين مقاله به دنبال اين است كه به اين سوال پاسخ دهد كه قائم مقام داراي چه معنا و مفهوم، اختيارات و آثار و نتايجي است.

Typically, Deputy divided into two categories: general and specific. The person who receives the total assets or shares from him is considered to be the general deputy of the carrier and previous owner. One of the main reasons of deputy of transferor is relationship and conjunction between the rights and obligations with transfer money. On this basis, for example, the buyer is considered special deputy about the effects of contracts that the seller selling is signed with others. He also recognizes the heir as the deputy of testator regarding his rights and obligations. The meaning of this statement is that the rights and obligations of the contracting the testator are transferred to the inheritance in the form of assets. The purpose of this paper is to answer this question: What is the meaning, the powers and the effects and the results of the deputy?
