انصاف و عدالت در سيستم قانونگذاري ايران و رويكردهاي قضايي امام خميني(س)

Fairness and Justice in Iranian Legislation System and Imam Khomeiniייs Judicial Approaches

انصاف به معناي توجه به تمام ابعاد مسيله براي صدور حكمي كه موجب اقناع وجدان عرف جامعه و فرد قضاوت كننده ميشود و نوعي برآيند اصول كلي حقوق است كه سختي قواعد را تلطيف ساخته و درونمايه عدالتي اي است كه قوانين بر اساس آن وضع شده و در نظام اسلامي ايران براي حفظ حقوق شهروندان به كار ميرود. از ديد امام خميني انصاف و عدالت، يكي از پايههاي مهم اجراي سياست در حكومت است و ركن اساسي آن بكارگيري قوه تعقل جهت جلوگيري از كجرويها، هدايت و اصلاح جامعه اسلامي است و اساس سياست، رعايت اصول اخلاقي مانند انصاف و عدالت و اصول عقلاني مانند عقل عملي است. وضع، تدوين و اجراي قانون با محوريت انصاف، موثرترين عامل استحكام جامعه و حفظ حقوق شهروندان است. مهمترين مصاديق و كاربرد انصاف در گستره قانون و خطابات امام خميني مشتمل بر: (دخالت دادن «وجدان فقهي» در استنباط و صدور احكام، در نظر گرفتن ضرورتها در قانونگذاري و...) است كه در پژوهش حاضر با روش تحليلي- كاربردي، جهت ارايه مدلي پيشنهادي براي استمداد كارگزاران سيستم قضايي ايران انجامشده است.

Fairness means paying attention to all aspects of the issue in issuance of a verdict that is expected to convince conscience and commonsense of the society and the individual. It is a sort of the consequence of general principles of law that softens rigidity of laws and rules. It is the theme of justice based on which the laws have been enacted for the protection of the rights of citizens in the Islamic Republic of Iran. In view of Imam Khomeini, fairness and justice constitute an important pillar of policymaking in governance. Its major requirement is using the capacity of rationality to prevent wrongdoings, to guide and reform the Islamic society. The basis of politics, then, is the observance of ethical codes such as fairness, justice, as well as rational tenets such as practical intellect. Enactment and enforcement of law based on fairness is the most effective factor for consolidation of the society and safeguarding the rights of the citizens. The most important evidences and applications of fairness in the realm of law and Imam Khomeiniʹs sermons include involving juridical conscience in understanding and issuing verdicts, taking into account the necessities in legislation, etc., that have been discussed in this paper upon an analytical-applied method in a bid to propose a model to follow by the agents of the Iranian judicial system.
