معافيت از كيفر موضوعي است كه قانونگذار در قانون مجازات اسلامي به آن پرداخته است. قانونگذار با ايجاد اين تأسيس، دست قاضي را براي بازگشت مجرم به جامعه و تخفيف مجازات او، البته فقط در جرايم كم‌اهميت يعني در جرايم درجه هفت و هشت بازتر گذاشته و تعيين كرده است كه در صورت احراز شرايط توسط قاضي مانند احراز اصلاح‌پذير بودن فرد و بار شدن جهات تخفيف بر او و نيز جبران ضرر و زيان شاكي، وي مي‌تواند فرد مرتكب را از كيفر معاف كند. معاذير معافيت از مجازات به‌طور كلي بستگي به وخامت و خطرناكي جرم ندارد بلكه مربوط به سياست كيفري بعضي از امور كه مقارن با ارتكاب بعضي از جرايم و موجب معافيت مرتكب از مجازات به‌شمار آمده است. به همين جهت يك دستور كلي در اين زمينه وجود ندارد كه مربوط به همه جرايم باشد، بلكه درمورد هر يك از جرايم كيفيات خاص بنا به ملاحظات سياست كيفري به‌عنوان معاذير معاف كننده از مجازات شناخته شده است
