Individualization of the Criminal Reaction of the Pre-trial (Prosecution) Stage in Iran's Criminal Law in Comparison with the Corresponding Legal Principles in French Law

فردي كردن واكنش كيفري سياستي است كه با لحاظ شخصيت متهم اتخاذ مي گردد. اين مفهوم در مرحله پيش دادرسي در حقوق ايران و فرانسه با راه كارهايي همچون تعليق تعقيب قابل اعمال است. اجراي اين سياست در فرايند تعقيب با چالش هاي اساسي همچون محدوديت هاي ناشي از الزامي بودن تعقيب، عدم توجه به حقوق بزه ديده، تخديش اصل برائت و تساوي مجازات ها همراه است. اجراي راه كارهاي فردي سازي و رفع چالش هاي اجراي آن، ضمن لزوم رعايت شرايط و الزامات قانوني، نيازمند تأمين امكانات مالي لازم، تخصصي سازي فرايند تعقيب و توجه به پرونده شخصيت متهم است. روش انجام اين تحقيق كتابخانه اي و بنيادي است.

Individualization of criminal reaction is a policy adopted with regard to the defendant's personality. This concept can be applied at the pre-trial stage in the legal systems of Iran and France with such measures as suspension of prosecution. The execution of this policy in the prosecution process is accompanied by fundamental challenges such as the constraints resulting from the compulsoriness of prosecution, failure to consider the victim's rights, the violation of the Presumption of Innocence and the equalization of punishments. The use of individualization strategies and removal of the challenges for its execution, while requiring to be done in accordance with the law, involve the provision of financial resources, specialization of the prosecution process, and consideration of the defendant's personality records. A library and basic research method has been used in this study.
