Civil Liability Arising from the Defect of Production with an Emphasis on the Genetically Modified (GM) (with a Comparative Study)

عدالت كه از اصلي ترين گزاره هاي حقوق به شمار مي آيد اقتضاء مي كند تا در بررسي هاي حقوقي خويش كه نهايتاً نيز ممكن است، نتايج اين تحقيقات براي سفر به وادي قانونگذاري رخت بربندد و به قوانين لازم الاجرا بدل شود، از قشر آسيب پذير جامعه دفاعي به غايت مطلوب، ارائه نماييم. شناسايي نهاد مسئوليت ناشي از عيب توليد يكي از نتايج مفروض دانستن گزاره پيش گفته است ، مسئوليتي كه از قواعد سنتي ضمان رهيده و در وادي عدالت ولو با ناديده انگاشتن برخي از اصول و قواعد آرميده است ، در اين نوع خاصي از مسئوليت مصرف كننده جايگاه ويژه اي دارد و قانونگذار در تلاش است تا بتواند از منافع او در برابر توليد كننده حمايت كند، و از طرفي توليد كننده را مسئول مطلق قلمداد نكند؛ زيرا مصالح اقتصادي و نياز جوامع به توسعه روي برتافتن نسبت به حمايت از توليد كننده را نيز برنمي تابد ، اين رويكرد در توليد محصولات متعدد از جمله محصولات تراريخته قابل اعمال و شايان توجه بوده و به نظر مي رسد، در حال حاضر مناسب ترين نوع مسئوليت با در نظر داشتن خصايص توليدات عصر حاضر است. لازم به ذكر است تحقيق صورت گرفته در اين نوشتار با توسل به روش توصيفي ـ تحليلي همچنين ، در نظر داشتن نمونه هاي قانوني داخلي و خارجي ، جهت بررسي مسئوليت ناشي از عيب توليد خصوصاً با رويكردي خاص برتوليد و عرضه محصولات تراريخته تدوين گرديده و در صدد دستيابي به نتايجي مطلوب در اين زمينه است.

The liability arising from fault of production is one of the results of this mission، the responsibility which has freed from the traditional rules of guarantee and، although by ignoring some of the principles and rules، has restsd in the realm of justice. In this particular type of responsibility، consumer has a special position or situation، and the legislator is trying to protect his interests against the producer، and، at the same time، dose not declare the producer as the unconditional responsible. This approach can be remarkable and applied in the production of multiple products، including the genetically modified (GM) crops، and at present and with regard to the production characteristics of this era، it seems the most appropriate type of liability. Production and supply of transgenic products developed in seeking to achieve the desired results in this field.
