چكيده فارسي :
عدالت با امتیاز استخراج معانی فقهی متنوع از آن، یكی از پراهمیت‌ترین و كاربردی‌ترین مفاهیم در فقه امامیه است. مهم‌ترین دیدگاه‌های فقهی مبین ساختار عدالت مشتمل بر: حسن رفتار ظاهری، ملكۀ راسخ در نفس انسانی، ترك ارتكاب حرام، عدم ظهور فسق در اعمال و پایبندی عملی به پایه‌های دین است كه با چالش‌ها و ثمرات فقهی معتنابهی مواجه خواهد بود كه تحلیل هر یك از آنها به سه عنصر اساسیِ حسن ظاهر، نحوۀ عملكرد یا رسوخ ملكۀ عدالت برمی‌گردد. برآیند معانی مذكور و استقرای تام در متون فقه امامیه، معنای نوینی از عدالت موسوم به «قدر متیقّن» عدالت را به ذهن متبادر می‌كند كه پاسخگوی چالش‌های درونی و بیرونی اقوال فقها خواهد بود. تحلیل و پاسخ هر یك در مقالۀ حاضر به تفصیل تبیین شده است.

Abstract: Jurisprudential thematic diversity : challenges andanswers (analytical study of nature of judges,justice at the scholars ,statement) jurisprudential views showing the structure of justice include the apparent behavioral goodness,pertinacious queen in human soul,shunning the forbidden deeds, lack of debauchery in behavior, and loyalty to the basis of religion which face with jurisprudential uses and challenges and the analysis of each of them returns to the three basic elements of goodness in appearance, how to act or the influence of the queen of justice. The mentioned concepts and the absolute induction in imams jurisprudenc texts bring new meanings of the justice related to the ‘certain quantity’to the mind which will respond to the internal and external challenges of the quotations of the jurists .
