NEW CHALLENGES OF INTELLECTUAL PROPERTY RIGHTS

حقوق مالكيت فكري بر حسب طبيعت پوياي خود و نيز به دليل ارتباط تنگاتنگي كه با جهاني شدن و تجارت برقرار كرده است، يكي از پرتحول ترين حوزه هاي حقوقي و اقتصادي در عصر كنوني به شمار مي آيد. اهميت اين موضوع از آنجا آشكار مي گردد كه امروزه يكي از عمده ترين حوزه هاي مناقشه انگيز ميان كشورهاي در حال توسعه و توسعه‌يافته، مقوله حمايت يا عدم حمايت از محصولات فكري و گستره آن مي باشد. از يكسو، كشورهاي توسعه يافته با تأكيد بر لزوم حمايت از اين حقوق، تقويت حمايت را موجب افزايش توسعه و تسهيل انتقال فن آوري به كشورهاي در حال توسعه مي دانند و از سوي ديگر كشورهاي جهان سوم با اين استدلال كه مالكيت فكري بايد وسيله اي براي تحقق توسعه باشد نه هدف، خواستار تعديل گستره حقوق مزبور و انحصارات ناشي از آن شده اند. علاوه بر مقوله توسعه، پيدايش و گسترش اينترنت نيز باعث بروز تحولات نويني در حوزه حقوق مالكيت فكري شده و مباحث و چالش هاي حقوقي جديدي را پيش روي آورده است. اين مقاله بر آنست تا مهم‌ترين تحولات اخير در حوزه مالكيت فكري ر ا به اختصار بررسي نمايد.

Because of its very dynamic nature and its close ties with global commerce, intellectual property law is one of the liveliest areas of law. The significant of this branch of law is manifested in the debate which is going on between developed and developing countries in terms of the scope of the protection of intellectual property rights. On the one hand, the developed country argue the stronger protection of intellectual property rights increases and facilitates the transfer of technology to the developing countries but, on the other hand, developing countries consider intellectual property rights as a means for development not an end by itself and as such are in favor some moderation in the scope and length of intellectual property rights. Moreover, in addition to the concept of development, the emergence and expansion of internet has also caused new developments in the field of intellectual property rights. These developments have posed new challenges which shall be discussed in this paper.
