مديريت پسماندها در حقوق ايران و فرانسه (با تاكيد بر قانون مديريت پسماندها مصوب 1383)

WASTES MANAGEMENT IN IRAN and FRANCE LAW EMPHASIZING ON WASTE MANAGEMENT LAW ACTED IN 2004

قانون مديريت پسماندها به عنوان نقطه عطفي در توجه نظام حقوقي ايران به مسئله «پسماند» در مورخ 83/2/20 به عنوان يك قانون جامع در زمينه مقابله با آثار خطرناك آلودگي و مشكلات ناشي از پسماندها در راستاي مديريت بهينه آنها با قيد دو فوريت به تصويب مراجع قانون گذاري رسيد. در اين مقاله ضمن ارزيابي نظام حقوقي حاكم بر مديريت پسماندها به جايگاه و مباني و مشكلات موجود در اين زمينه با نگاهي به تجربه قانون گذاران فرانسوي (به عنوان نمونه) پرداخته شده است. فرض اساسي اين نوشتار بر اين امر استوار است كه براي مبارزه و اقدام عليه اين مشكل تكيه صرف بر ابزارهاي حقوقي كافي نبوده و نياز به استفاده و هماهنگي ساير سياست ها، زمينه ها و ابزارهاي غيرحقوقي و تجميع همه امكانات جامعه در كنار «سياست تقنيني» مطلوب، دقيق و واقع گرايانه نيز احساس مي شود.

Wastes Management law as a turning point in the view of Iran's legal system towards the issue of wastes was approved by legislator authorities on 5/09/2004, with a two-starred agency, as a comprehensive law against harmful effects of pollution and problems due to wastes for their optimal management. In this paper, in addition to evaluating of the legal system governing on wastes management, it also considers the position , principles and current issues in this regard, while viewing the experience of French law makers (for instance).The essential assumption of this paper is based on the fact that, simply relying on legal means to fight and to take action against this problem is not sufficient and the necessity to use and coordination of other policies, fields and non juridical means and uniting of society facilities in the long with accurate, realistic and ideal legislative policy is felt.
