در تكاپوي توسعه حقوق بين الملل اينترنت

انقلاب تكنولوژيكي، آزادي بيان را به نحوي مدرن متأثر ساخت كه توسعه راديو و تلويزيون قبلاً آنرا دگرگون نكرده بود. اين امر رفته رفته بامشاركت فرهنگي در زمينه هاي مختلفي از جامعه پررنگ تر شد و مراوداتي كه تا پيش از آن در قالب هايي محدودتر صورت مي گرفت، توسعه يافت. با اين حال، به همان ميزان نيز امكان كنترل و ايجاد محدوديت در اقسام مختلف ارتباطات در اشكال جديدي، هويدا شد. چنين كنترلي كه عمدتاً از طريق سازوكارهاي دولتي و در مقابله با جريان مبادله آزادانه اطلاعات صورت مي گيرد، با ظهور شبكه هاي اجتماعي وارد مرحله جديدي شده است. سانسور و نظارت بر محتواي داده ها و پيشرفت شيوه هاي ره گيري مكاتبات و مكالمات در اين شبكه ها، اين پرسش جدي را به ذهن متبادر مي كند كه آيا با انقلاب تكنولوژيكي، زمينه اي براي شكل گيري انقلابي حقوق بينالملل اينترنت فراهم شده است؟ در اين مقاله درصدديم تا با طرح اين ادعا كه هنوز مقوله اي به نام حقوق بين الملل اينترنت در قالب مجموعه اي منسجم و با ثبات شكل نگرفته است، به ويژه با ظهور و رواج روبه رشد شبكه هاي اجتماعي، به ضرورت و چگونگي توسعه اين حوزه حقوقي در سطح بين المللي مي پردازد

The Internet has always been an international law problem. Clearly the International institutions ranging from the International Telecommunication unio‎n to the U.N. General Assembly are becoming increasingly involved in regulating the Internet. But it seems that still there is a long road to a coherence international system of rules and regulations concerning internet law in international community. Apart from the question of the desirability of international rules and regulations, the problem of domestic censorship of filtering as a serious problem, to some extent endangered some human rights principles as free flow of information, principle of freedom of expression, right to privacy, openness and etc. in this article, by focusing on the universality and the unity of cyberspace and the place of co operation among states t enhance the international relations, we will consider the necessity and the possibility of extension of rules and principles of general international law to this context.
