چالش هاي حقوقي ترابردپذيري شماره تلفن همراه و نظارت دولت؛ با تأكيد بر مصوبات 189 و 232 كميسيون تنظيم مقررات ارتباطات

Legal Challenges Facing Mobile Number Portability Technology and Government Supervision: With Emphasis on Ratifications 189 and 232 of Communications Regulatory Commission

توسعه فن­ آوري‌هاي وابسته به تلفن‌همراه و افزايش تقاضاي مشتركين براي استفاده از اين تكنولوژي سبب پيدايش فن­ آوري نويني در زمينه تلفن ‌همراه شده است. يكي از مهم­ترين اين فن­آوري‌ ها فراهم‌آوردن امكان تغيير اپراتور تلفن‌ همراه بدون نياز به تغيير شماره تلفن (ترابردپذيري) است. اين امر از آنجايي داراي اهميت فراوان است كه برخي از مشتركين با وجود نارضايتي از اپراتور خود به علت اهميت شماره، قادر به تعويض سيم كارت خود نمي‌باشند. از آنجا كه مهم‌ترين هدف از ايجاد چنين امكاني، دستيابي به سود بيشتر اقتصادي و افزايش رقابت در بازارهاي مخابراتي است، ابعاد اقتصادي تأثير شگرفي بر نوع مقررات‌گذاري و الزامات قانوني اين فن‌آوري دارند. از طرف ديگر با توجه به نو ظهور بودن اين پديده، ورود آن چالش­ هاي جديد در زمينه نظارت و مقررات­ گذاري پيش روي دولت قرار مي­ دهد. در اين پژوهش سعي شده ابعاد حقوقي اين خدمات نوين با تأكيد بر فن­آوري ترابردپذيري از منظر نظارت واكاوي و مصوبات 189 و 232 كميسيون تنظيم مقررات و ارتباطات كه تنها اسناد قانوني كشور در اين موضوع است، مورد تجزيه تحليل حقوقي قرار بگيرد.

The development of technologies associated to mobile, and, also increase of customers’ demands to take advantage from the foresaid technologies have led to new technologies on mobile. One of the most considerable technologies is to transfer the mobile operator, without any number portability. This issue is known significant; because there are some customers who cannot exchange their SIM card, although they may not be satisfied with their operator. Since achieving more economic profits and, growth of competition in telecommunication markets are known as goals of said prerogative, the economic aspects have influenced, so notably, on regulation and legal requirements of the technology. Hence, regarding the significance of the legal aspects of the event, to which it’s been referred, in this study, the legal aspects of technology are being analyzed. Both legal frameworks identified mandatory by the regulatory authority and considering regulation methods on the technology are analyzed in this article. Moreover, since this issue is a recent phenomenon in Iran, the legal aspects of the technology in Iran have been studied.
