Ombudsman Institution Typology: An Approach to the Recognition of Genuine Ombudsman

در اين پژوهش سعي مي شود با روش توصيفي- تحليلي انواع آمبودزمان­ هاي اصيل در سطح ملي مورد مطالعه قرار گيرد و آن­گاه به بررسي نهادهاي ديگري پرداخته شود كه ذيل عنوان كلي «شبه ­آمبودزمان» يا «آمبودزمان ­مانندها» طبقه ­بندي مي­شوند. تنوع و گستردگي اين نهاد در اقصي نقاط جهان به اين دليل است كه ايده آمبودزمان در برخورد و تعامل با فرهنگ ­هاي مختلف دچار فراز و نشيب­هاي بسياري شده است و به دليل انعطاف ­پذيري بسيار، خود را با اقتضائات هر جامعه منطبق كرده و اشكالي متفاوت و گاهي متناقض يافته است. نوشتار پيش‌رو، با هدف نيل به يك مفهوم صحيح و منقح از ايده آمبودزمان و پس از مطالعه و بررسي انواع نهادهاي آمبودزماني به اين نتيجه مي‌رسد؛ صرفا تأسيسي را مي­توان ذيل عنوان آمبودزمان اصيل دسته‌ بندي كرد كه از پشتوانه قانوني بويژه قانون اساسي برخوردار باشد و مقامات آن با اكثريت­ هاي خاص پارلماني نصب و عزل شوند و به پارلمان يا رئيس جمهور و يا مردم پاسخگو باشند. به بيان بهتر، آمبودزمان ­هاي كلاسيك و تركيبي را مي­توان در زمره آمبودزمان­ هاي اصيل به شمار آورد.

In this article, we attempt to study a variety of genuine ombudsman institutions at the national level and the institutions which are classified under the general title "quasi-ombudsm@n" or "ombudsman-like". The reason behind the diversity and complexity of these institutions around the world lies at this point that the idea of ​​ombudsman in dealing and interacting with different cultures has been faced with many ups and downs and because of its great flexibility, it has adapted itself with the requirements of every society and has taken different yet sometimes contradictory forms. To reach our goal, that is, to achieve a correct and expurgated concept of the notion of ombudsman and after studying different types of ombudsman institutions, the article concludes that the independent Ombudsman institutions which are supported by the Constitution or law and their officials appointed or removed by specific majorities are the Genuine Ombudsman Institutions. In other words, Classical and Hybrid Ombudsman Institutions could be regarded as Genuine Institutions.
