Investigating the Legal-Jurisprudential Possibility of Devotion (Waqf) of Intellectual Property

فرض مشهور فقهاي شيعه در متعلّق وقف بر مبناي روايات اعيان است. حال سؤالي به ذهن پژوهشگر متبادر مي گردد و آن اينكه، آيا توسعة متعلّق وقف به مالكيت فكري و امور معنوي نيز امكان دارد يا خير؟ نگارنده در مقالة حاضر به روش تحليلي توصيفي برخلاف پيش فرض مشهور، توسعة متعلّق وقف به غيراعيان را ضمن اثبات ماليّت محصولات فكري و مشروعيّت مالكيت معنوي، مدلّل مي نمايد، معتقد است وقف امور معنوي نيز از حيث حكم وضعي صحيح است.

The famous hypothesis of the Shi’a jurisprudents in the subject of endowment - based on the narrations of the prophet of Islam - is that endowment can be just property. Now the question is whether it is possible to develop the belongings of the endowment to intellectual property and spiritual affairs or not? In this article, the author uses descriptive method, contrary to the famous assumption, trying to develop the subject of endowment while proving the legitimacy of intellectual properties endowment. Finally it is concluded that endowment of spiritual affairs is also correct.
