تحليل جرايم شركتي در پرتو نظام‌هاي اقتصادي

Analysis of Corporate Crimes in the Light of Economic Systems

شركت‌ها يا بنگاه­ هاي تجاري نقش بسيار زيادي در رشد و شكوفايي اقتصادي كشورها دارند و با جهاني شدن اقتصاد و رشد كمّي و كيفي اين اشخاص حقوقي در ابعاد ملي و بين­ المللي، جهان اقتصاد به طور كلي و نظام اقتصادي كشورها به طور خاص، با پديده­اي نوظهور به نام «جرايم شركت‌ها (بنگاه ­ها)» يا به تعبيري «جرايم شركتي» مواجه شده­ اند. جرايم شركتي يا جرايم اشخاص حقوقي تجاري و مرتكبان آن كه در دهه ­هاي اخير تابع حقوق كيفري و بنابراين داراي مسئوليت كيفري شده‌اند را مي­ توان به تعبيري، مفهوم بازانديشيده ­شده از جرايم يقه­ سفيدان تلقي نمود كه در حيطۀ مطالعاتي جرم ­شناسي­ هاي انتقادي قرار مي­ گيرند و به معناي اعمال مجرمانۀ شركت‌هاي تجاري است كه در بسترهاي شغلي و توسط اقدامات جمعي مديران يا كاركنان شركت صورت مي­ گيرد. شيوع اين جرايم به خصوص با گسترش كمّي و كيفي اشخاص حقوقي، به ويژه شركت‌هاي تجاري باعث شده تا پژوهشگران اين حوزه براي تحليل و علت ­شناسي اين جرايم به مطالعات گسترده روي آورند و عوامل مختلفي كه ممكن است منجر به ارتكاب اين جرايم گردند را تبيين نمايند. اين جرايم مانند ساير جرايم از اتحاد و اقتران عوامل متعددي پديد مي­ آيند كه يكي از اين عوامل، ماهيت نظام اقتصادي است. به عبارت ديگر، گاهي نوع و ماهيت نظام اقتصادي مي­ تواند بسترساز ارتكاب اين جرايم گردد. اين امر در نظام اقتصادي ايران كه در آن هنوز بسياري از شركت‌هاي تجاري در تصدي دولت هستند و به همين دليل زمينه براي نفوذ و رانت­ جويي آنها فراهم است، مي­ تواند حائز اهميت باشد. در اين مقاله، جرايم شركتي را در پرتو نظام ­هاي اقتصادي، مورد بررسي و تحليل قرار داده و به فراخور مطالب، به نظام اقتصادي ايران نيز اشاره خواهيم نمود

Companies or commercial enterprises have an important role in the economic development of countries. With the globalization of economy and increasing of these legal entities in terms of quality and quantity، the world economy in general and economic system of countries in particular have faced a newly-emerged phenomenon called “crimes of corporations” or “corporate crimes”. corporate crimes or crimes of commercial legal entities as well astheir offenders which in recent decades have been subject to criminallaw and criminal liability، can be considered as the revisited concept of white-collar crimes which are classified in the area of critical criminology. It can be defined as the criminal acts of commercial enterprises whichare committed in the context of the business by the collective action ofthe directors or officers of the enterprises. Outbreak of these crimes specially because of the increase in the quality and number of legal entities، in particular commercial enterprises، has caused researchers to get interested inextensivestudiestoexplainthedifferentcausesofcommitment of these crimes. Like any other crime، these crimes are caused by various factors such as the nature of economic system. in other words،commitmentofthesecrimescanberootedinthe nature and the type of economic system. This is of great importance in the economic system of Iran in which many commercial entities are administered by the government because the reisalotofopportunities for rent-seeking behaviors. Inthis essay، corporate crimes will be analyzed in the light of economic systems، and referencewillalsobemade، where appropriate، totheeconomicsystemofIran.
