Globalization Effects on the issue of environmental law protection

جهاني‌شدن عصري توأم با تضادها است كه تغييرات سريع و مشكلات مستمري را براي جامعه بشري و در ابعاد مختلف به همراه داشته است. اين امر به معناي رشد وابستگي متقابل ميان اقتصادها و جوامع از طريق جهاني‌سازي اطلاعات، فناوري‌، خدمات، عامل سرمايه و سرمايه‌گذاري است كه ظرفيت سنتي دولت‌ها براي كنترل اين پديده را به چالش كشيده است. سرعت زياد يكپارچگي اقتصادي به شكل‌گيري بازارها و اقتصادهاي به هم وابسته جهاني منجر گرديده و مقابله با آثار منفي اين امر نيازمند همگام‌ سازي سياست‌هاي حقوقي در ابعاد مختلف گرديده است. يكي از ابعاد اين هماهنگي در زمينه حقوق محيط زيست و به واسطه علايق و منافع مشترك جامعه جهاني در حمايت حقوقي از آن است. لذا هدف از اين مقاله بررسي آثار جهاني ‌شدن بر مقوله حقوق محيط­ زيست با رويكرد حمايتي و همچنين ارائه راهكارهاي لازم براي كاهش آثار منفي فرايند جهاني ‌شدن بر محيط زيست، مانند توجه ويژه به توسعه پايدار، حمايت از فناوري‌هاي دوستداران حقوق محيط زيست، اصلاح الگوي مصرف انرژي و تشويق به استفاده از انرژي‌هاي تجديد‌‌پذير و غيره است.

The Current Globalization is intertwined with contradictions that causes rapid changes and continues problems for human society in different respects. This means that, the growing, reciprocal dependence of different economies and societies through globalization of information, techniques, and services is a mean of an investment that challenges the traditional capacities of governments to control this issue. The rapid flow of economic integration leads to forming new markets and economies confronting with negative effects of which needs concordance of legal policies in variety of aspects. On aspect of this coordination is in environmental rights and the international interests in legal protection of that. Hence, the aim of this article is to study the impacts of globalization on environmental rights with protective approach .in addition, taking necessary measurements’ to reduce the negative impacts of globalization on environment such as special attention to sustainable developments, protecting the technologies of supporters of environment, amending the pattern of energy consumption and motivating the use of renewable energies are among the aims of this article.
