آزادي مطبوعات در منظر حق دسترسي آزاد به مطبوعات

C Freedom of the Press beside Freedom of Information

همواره چالش اساسي در مطبوعات، تعيين حدود آزادي‌هاي آن‌ها بوده است. مطبوعات هميشه از يك‌سو بايد منتقد و امر به معروف و ناهي از منكر حكومت‌ها باشند و از سوي ديگر پشتيبان اطلاعاتي و منعكس‌كنندة صداي تودة مردم باشند؛ لذا تعيين حدود آزادي مطبوعات بسيار مهم و ضروري است. مطبوعات جزئي از رسانه‌هاي گروهي هستند كه در قانون اساسي به آزادي آن‌ها پرداخته شده است و حتي قانوني به نام همين رسانة گروهي به تصويب رسيده است. در واقع قانون مطبوعات در مقام بيان بايدها و نبايدهاي عملكردي مطبوعات هستند كه حدود آزادي مطبوعات را مشخص كرده است. از سوي ديگر حق دسترسي آزاد به اطلاعات يكي از حقوق بنيادين بشر در اسناد حقوقي ملي و بين‌المللي است كه مورد توجه قرار گرفته است. هر شهروند حق دارد با استفاده از مطبوعات و ساير رسانه‌هاي نشر عقايد و افكار به درست‌ترين اخبار و اطلاعات داخلي و خارجي و تحولات جهاني دسترسي داسته باشد. به زعم نگارندة مقاله يكي از عوامل كليدي تعيين‌كنندة حدود آزادي مطبوعات در كنار اخلال به مباني اسلام و حقوق عمومي، ميزان دسترسي شهروندان به اطلاعات است كه در اين مقاله به دنبال تبيين تلازم بين آزادي مطبوعات و حق دسترسي آزاد به اطلاعات هستيم

Determining the freedom limits has been always in dispute. On the one hand, Press should be critical and commanding right and forbidding wrong, on the other hand it should reflect the voice of the people as well as support the information; so determining the freedom limits has been so crucial. The press is an important part of mass media, and then in the constitution, freedom of the Press has been expressed. However there is an especial law in the name of the press. Indeed the press laws should indicate Dos and Don’ts. Also freedom of information as fundamental human right has been recognized in the national and international legal documents. Any person have right to access to information by using the press as well as other media freely therefore they will be able to access the right domestic and foreign news and information as well as international changes. In this article, the access of people to information as one of the important factors in freedom information has been indicated, so the main purpose of this paper is to indicate the inseparability between freedom of the Press and freedom of information
