Anomie of the Walls and the Concealed Nomos of the Earth: The Geometry of Modern Political Theory

مقاله حاضر بر اين پيش‌فرض استوار است كه نظريه سياسي مدرن بر بنياد يك هندسه قرار دارد: هندسه سياسي داخل و خارج. هم‌چنين مفهوم بنيادي فلسفه سياسي را نه آزادي و نه قدرت سياسي بلكه مرز مى‌داند - مرزي كه قلمرو «حاكميت» يك كشور را مي‌سازد. در اين چارچوب، مقاله در جست‌وجوى مكان‌هاي هندسي و فضاهايى است كه نقاط مسأله‌ساز حاكميت «ملت-دولت»‌اند و دل‌مشغول موقعيت سياسي گروه‌هاي مختلفي از مردم است كه در اين نواحى سرحدهاى قضايى، حقوقى و سياسى ملت-دولت‌ها را به چالش كشيده‌اند. اين مقاله آنها را گروه‌هاى مختلفى از افراد «بى‌دولت» در نظر دارد. البته موضوع مقاله حاضر مستقيماً هيچ‌يك از آنان نيست، بلكه آنها امكاني هستند براي فهم افول ملت-دولت در نظم «مابعد وستفاليايي». مقاله مي‌كوشد افول ملت-دولت را در اين نظم جديد جهاني و در پرتو جدايي «حاكميت» از «دولت» دنبال ‌كند و از اين طريق به «نوموس» پنهان فضاى حاضر سياسى جهان برسد: «ديوارهاي مرزي». مقاله مدعى است اكنون «نوموس» زمين با «ديوارها» تعريف مى‌شود. بعد از بررسي رانه‌هاي فراگير به ديواركشى به اين نتيجه مي‌رسد كه محل ديوارها ناحيه‌اي آنوميك است. سپس با تبيين اين امر به ميانجي «وضعيت استثنايي» در جهان معاصر نشان مي‌دهد ساختارى كه به تمايز درون و بيرون شكل مى‌دهد، وقتى در مقام بخشى از خطوطى شناخته مى‌شود كه در حال زدودن تمايزهاي ساختاري ملت-دولت‌ها هستند، خود را نقض مى‌كند. در واقع جدل بر سر نوعي منطقه آنوميك در تعليق است و درست به همين خاطر در عين انسداد هر امكاني به سوي رهايي، مي‌توان از نوعي سياست مقاومت سخن گفت. بنابراين نقشه مقاله حاضر اين‌چنين است: به‌منظور شناخت وضع موجود جهان، بايسته است كه از داده‌هاي ساختاري آغاز كرد، تغييرات صورت‌گرفته را سنجيد و دوباره پرسيد سياست در اين زمينه چه نقشي مي‌تواند ايفا كند.

This paper works with the assumptions that the modern political theory is based on geometry: the political geometry of the inside and outside. It also considers that the fundamental concept of political philosophy is neither freedom nor political power but borders. In this framework, the paper aims to understand the locus and spaces that are problematic for nation-state sovereignty and it is concerned with the political status of groups of people that have challenged the juridical and political limits of nation-states. It calls these people "stateless" and "non-state" people. These groups are not the topic of this paper but they offer the possibility to understand the decline of nation-state sovereignty in the "post-Westphali@n" order. The paper tries to trace the waning of sovereignty in this new global order and demonstrates that, as nation-state sovereignty wanes, states and sovereignty come apart from one another. an‎d through this, we reach the concealed nomos of the political space within which we still live: "Boundary Walls". This paper shows that the nomos of the earth is defined by the Walls. It concludes that, the location of these vertical structures is an anomic space. Further, it will be explained that such a structure taken to mark and enforce an inside/outside distinction appears as a self-defeating paradox. Indeed, there is a struggle for anomic zone of suspension so that we can think of a kind of Politics of Resistance. The agenda of the paper is thus to restart from the structural facts, to measure the changes that have occurred and to ask once again what the role of politics can contribute in this context
